A BILL TO BE ENTITLED
AN ACT
relating to notice of planned and unplanned service interruptions
provided to ERCOT by certain electric generation service providers.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 35, Utilities Code, is
amended by adding Section 35.0022 to read as follows:
Sec. 35.0022. SERVICE INTERRUPTION NOTIFICATIONS. (a)
This section applies only to a provider of electric generation
service described by Section 35.0021(a).
(b) The commission by rule shall require a provider of
electric generation service to provide to the independent
organization certified under Section 39.151 for the ERCOT power
region notice of each planned or unplanned service interruption
within a reasonable time after the interruption of the service has
impacted generation availability. The independent organization
shall make each notice publicly available.
(c) The notice described by Subsection (b) shall state the
reasons for the planned or unplanned service interruption and may
be provided in any reasonable manner, including by e-mail or an
electronic interface on the provider's Internet website.
SECTION 2. This Act takes effect September 1, 2023.
