| 7 | 7 | | relating to the dates a retail fireworks permit holder may sell |

| 8 | 8 | | fireworks to the public. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2154.202(g), Occupations Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (g) Except as provided by Subsection (h), a retail fireworks |
|---|
| 13 | 13 | | permit holder may sell fireworks only to the public, and only during |
|---|
| 14 | 14 | | periods: |
|---|
| 15 | 15 | | (1) beginning June 24 and ending at midnight on July 5 |
|---|
| 16 | 16 | | [4]; |
|---|
| 17 | 17 | | (2) beginning December 20 and ending at midnight on |
|---|
| 18 | 18 | | January 1 of the following year; and |
|---|
| 19 | 19 | | (3) beginning May 1 and ending at midnight on May 5 if |
|---|
| 20 | 20 | | the fireworks are sold at a location that is not more than 100 miles |
|---|
| 21 | 21 | | from the Texas-Mexico border and that is in a county in which the |
|---|
| 22 | 22 | | commissioners court of the county has approved the sale of |
|---|
| 23 | 23 | | fireworks during the period. |

| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2023. |
