66 AN ACT
77 relating to motorcycle profiling by peace officers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 2, Code of Criminal Procedure, is
1010 amended by adding Article 2.1315 to read as follows:
1111 Art. 2.1315. MOTORCYCLE PROFILING PROHIBITED. (a) In this
1212 article:
1313 (1) "Law enforcement agency" and "motor vehicle stop"
1414 have the meanings assigned by Article 2.132.
1515 (2) "Motorcycle profiling" means a law
1616 enforcement-initiated action based wholly or partly on an
1717 individual operating a motorcycle or wearing motorcycle-related or
1818 motorcycle club-related paraphernalia rather than on the
1919 individual's behavior or on information identifying the individual
2020 as having engaged in criminal activity. The term includes a motor
2121 vehicle stop that is made with respect to an individual operating a
2222 motorcycle and that the peace officer extends beyond the period
2323 necessary to effectuate the purpose of the stop.
2424 (b) A peace officer may not engage in motorcycle profiling.
2525 (c) Each law enforcement agency in this state shall adopt a
2626 detailed written policy on motorcycle profiling. The policy must:
2727 (1) clearly define acts constituting motorcycle
2828 profiling;
2929 (2) strictly prohibit peace officers employed by the
3030 agency from engaging in motorcycle profiling;
3131 (3) implement a process by which an individual may
3232 file a complaint with the agency if the individual believes that a
3333 peace officer employed by the agency has engaged in motorcycle
3434 profiling with respect to the individual; and
3535 (4) require appropriate disciplinary action to be
3636 taken against a peace officer employed by the agency who, after an
3737 investigation, is shown to have engaged in motorcycle profiling in
3838 violation of the agency's policy adopted under this article.
3939 SECTION 2. Not later than December 1, 2023, each law
4040 enforcement agency in this state shall adopt the policy required by
4141 Article 2.1315, Code of Criminal Procedure, as added by this Act.
4242 SECTION 3. This Act takes effect September 1, 2023.
