55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the allocation of child care expenses for a child
88 subject to a child support order.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 154.008, Family Code, is amended to read
1111 as follows:
1212 Sec. 154.008. PROVISION FOR MEDICAL SUPPORT, [AND] DENTAL
1313 SUPPORT, AND CHILD CARE SUPPORT. (a) The court shall order medical
1414 support and dental support for the child as provided by Subchapters
1515 B and D.
1616 (b) If a party incurs child care expenses in order to seek or
1717 maintain gainful employment, or receive higher education or
1818 vocational training in anticipation of gainful employment, the
1919 court shall determine and allocate between the parties, according
2020 to the parties' circumstances, reasonable child care expenses.
2121 SECTION 2. The change in law made by this Act constitutes a
2222 material and substantial change of circumstances under Section
2323 156.401, Family Code, sufficient to warrant modification of a court
2424 order or a portion of a decree that provides for the support of a
2525 child rendered before the effective date of this Act.
2626 SECTION 3. The change in law made by this Act applies only
2727 to a proceeding to establish or modify a child support obligation
2828 that is pending in a trial court on or filed on or after the
2929 effective date of this Act.
3030 SECTION 4. This Act takes effect September 1, 2023.
