7 | 7 | | relating to the allocation of child care expenses for a child |

8 | 8 | | subject to a child support order. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 154.008, Family Code, is amended to read |
---|
11 | 11 | | as follows: |
---|
12 | 12 | | Sec. 154.008. PROVISION FOR MEDICAL SUPPORT, [AND] DENTAL |
---|
13 | 13 | | SUPPORT, AND CHILD CARE SUPPORT. (a) The court shall order medical |
---|
14 | 14 | | support and dental support for the child as provided by Subchapters |
---|
15 | 15 | | B and D. |
---|
16 | 16 | | (b) If a party incurs child care expenses in order to seek or |
---|
17 | 17 | | maintain gainful employment, or receive higher education or |
---|
18 | 18 | | vocational training in anticipation of gainful employment, the |
---|
19 | 19 | | court shall determine and allocate between the parties, according |
---|
20 | 20 | | to the parties' circumstances, reasonable child care expenses. |
---|
21 | 21 | | SECTION 2. The change in law made by this Act constitutes a |
---|
22 | 22 | | material and substantial change of circumstances under Section |
---|
23 | 23 | | 156.401, Family Code, sufficient to warrant modification of a court |
---|
24 | 24 | | order or a portion of a decree that provides for the support of a |
---|
25 | 25 | | child rendered before the effective date of this Act. |
---|
26 | 26 | | SECTION 3. The change in law made by this Act applies only |
---|
27 | 27 | | to a proceeding to establish or modify a child support obligation |
---|
28 | 28 | | that is pending in a trial court on or filed on or after the |
---|
29 | 29 | | effective date of this Act. |
---|
30 | 30 | | SECTION 4. This Act takes effect September 1, 2023. |
