66 AN ACT
77 relating to eligibility for Medicaid for breast and cervical
88 cancer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.024(y), Human Resources Code, is
1111 amended to read as follows:
1212 (y) The commission shall provide medical assistance to a
1313 person in need of treatment for breast or cervical cancer who is
1414 eligible for that assistance under the Breast and Cervical Cancer
1515 Prevention and Treatment Act of 2000 (Pub. L. No. 106-354) and who
1616 has a family income that is at or below 250 percent of the federal
1717 poverty level. The commission shall provide the assistance for a
1818 continuous period during which the person requires that
1919 treatment. The executive commissioner shall simplify the provider
2020 enrollment process for a provider of that medical assistance and
2121 shall adopt rules to provide for certification of presumptive
2222 eligibility of a person for that assistance. In determining a
2323 person's eligibility for medical assistance under this subsection,
2424 the executive commissioner, to the extent allowed by federal law,
2525 may not require a personal interview.
2626 SECTION 2. Section 32.024(y), Human Resources Code, as
2727 amended by this Act, applies only to an initial determination or
2828 recertification of eligibility of a person for medical assistance
2929 for breast or cervical cancer under Section 32.024(y), Human
3030 Resources Code, made on or after the date the section is
3131 implemented, regardless of the date the person applied for that
3232 assistance.
3333 SECTION 3. If before implementing any provision of this Act
3434 a state agency determines that a waiver or authorization from a
3535 federal agency is necessary for implementation of that provision,
3636 the agency affected by the provision shall request the waiver or
3737 authorization and may delay implementing that provision until the
3838 waiver or authorization is granted.
3939 SECTION 4. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2023.
