44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the permissible uses of the school safety allotment and
77 the creation of a mental health allotment under the Foundation
88 School Program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 48.115(b), Education Code, is amended to
1111 read as follows:
1212 (b) Funds allocated under this section must be used to
1313 improve school safety and security, including costs associated
1414 with:
1515 (1) securing school facilities, including:
1616 (A) improvements to school infrastructure;
1717 (B) the use or installation of physical barriers;
1818 and
1919 (C) the purchase and maintenance of:
2020 (i) security cameras or other security
2121 equipment; and
2222 (ii) technology, including communications
2323 systems or devices, that facilitates communication and information
2424 sharing between students, school personnel, and first responders in
2525 an emergency;
2626 (2) providing security for the district, including:
2727 (A) employing school district peace officers,
2828 private security officers, and school marshals; and
2929 (B) collaborating with local law enforcement
3030 agencies, such as entering into a memorandum of understanding for
3131 the assignment of school resource officers to schools in the
3232 district; and
3333 (3) school safety and security training and planning,
3434 including:
3535 (A) active shooter and emergency response
3636 training;
3737 (B) prevention and treatment programs relating
3838 to addressing adverse childhood experiences; and
3939 (C) the prevention, identification, and
4040 management of emergencies and threats, using evidence-based,
4141 effective prevention practices and including the establishment of
4242 [:
4343 [(i) providing licensed counselors, social
4444 workers, and individuals trained in restorative discipline and
4545 restorative justice practices;
4646 [(ii) providing mental health personnel and
4747 support;
4848 [(iii) providing behavioral health
4949 services;
5050 [(iv) establishing] threat detection and
5151 reporting systems[; and
5252 [(v) developing and implementing programs
5353 focused on restorative justice practices, culturally relevant
5454 instruction, and providing mental health support; and
5555 [(4) providing programs related to suicide prevention,
5656 intervention, and postvention].
5757 SECTION 2. Subchapter C, Chapter 48, Education Code, is
5858 amended by adding Section 48.117 to read as follows:
5959 Sec. 48.117. MENTAL HEALTH ALLOTMENT. (a) A school
6060 district with an enrollment less than 1,000 students is entitled to
6161 an annual allotment of $100,000; and
6262 (b) a school district with an enrollment greater than 1,000
6363 students is entitled to an annual allotment of $100 per enrolled
6464 student as provided by appropriation to support mental health
6565 services at the district.
6666 (c) Funds allocated under this section:
6767 (1) must be used to develop or enhance a comprehensive
6868 school mental health system that, through the implementation of
6969 programs, practices, and procedures in accordance with Section
7070 38.351, provides a tiered array of supports and services in the
7171 educational setting that contribute to:
7272 (A) a positive school climate;
7373 (B) the development of skills related to managing
7474 emotions, establishing and maintaining positive relationships, and
7575 responsible decision-making;
7676 (C) the learning and well-being of students with
7777 or at risk of mental health or substance use conditions;
7878 (D) family and community engagement;
7979 (E) reduced exclusionary discipline practices;
8080 and
8181 (F) staff wellness; and
8282 (2) may be used to pay for costs associated with:
8383 (A) the salary of school personnel responsible
8484 for planning, coordinating, delivering, or monitoring supports and
8585 services described by Subdivision (1);
8686 (B) training school personnel regarding
8787 effective practices and district and campus procedures to support
8888 student mental health;
8989 (C) a contract-based collaborative effort or
9090 partnership with one or more local community programs, agencies, or
9191 providers; and
9292 (D) developing and implementing programs focused
9393 on restorative justice practices; and
9494 (3) must be administered by licensed counselors,
9595 social workers, and individuals trained to provide mental health
9696 support and behavioral health services.
9797 (d) Funds allocated for purposes of this section may not be
9898 used to supplant any other funds that may be provided for the same
9999 purpose.
100100 (e) Not later than June 1 of each year and in accordance with
101101 commissioner rule, each school district shall submit to the
102102 commissioner information regarding the outcomes and expenditures
103103 related to funds allocated to the district under this section.
104104 (f) Not later than September 1 of each year, the
105105 commissioner shall publish a report regarding the use of funds
106106 allocated under this section during the preceding school year,
107107 including information regarding the programs, personnel, and
108108 resources implemented, employed, or purchased by school districts
109109 using the funds and other purposes for which the funds were used.
110110 SECTION 3. This Act takes effect September 1, 2023.
