A BILL TO BE ENTITLED
AN ACT
relating to a tenant's provision of notice to a landlord for a
repair or remedy through an online apartment portal.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 92.052(d), Property Code, is amended to
read as follows:
(d) The tenant's notice under Subsection (a):
(1) must be in writing only if the tenant's lease is in
writing and requires written notice; and
(2) may be provided by the tenant to the landlord
through an online apartment portal, if one is maintained by the
landlord and rent is paid through the portal.
SECTION 2. Section 92.052(d), Property Code, as amended by
this Act, applies only to a lease agreement entered into or renewed
on or after the effective date of this Act.
SECTION 3. This Act takes effect September 1, 2023.
