| 7 | 7 | | relating to increasing the criminal penalty for the offense of |
|---|
| 8 | 8 | | trafficking of persons if committed at certain locations. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 20A.02(b-1), Penal Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (b-1) An offense under this section is a felony of the first |
|---|
| 13 | 13 | | degree punishable by imprisonment in the Texas Department of |
|---|
| 14 | 14 | | Criminal Justice for life or for a term of not more than 99 years or |
|---|
| 15 | 15 | | less than 25 years if it is shown on the trial of the offense that |
|---|
| 16 | 16 | | the actor committed the offense in a location that was: |
|---|
| 17 | 17 | | (1) on the premises of or within 1,000 feet of the |
|---|
| 18 | 18 | | premises of: |
|---|
| 19 | 19 | | (A) a school; |
|---|
| 20 | 20 | | (B) a juvenile detention facility; |
|---|
| 21 | 21 | | (C) a post-adjudication secure correctional |
|---|
| 22 | 22 | | facility; or |
|---|
| 23 | 23 | | (D) a residential child-care facility, as |
|---|
| 24 | 24 | | defined by Section 42.002, Human Resources Code; or |
|---|
| 25 | 25 | | (2) on premises or within 1,000 feet of premises |
|---|
| 26 | 26 | | where: |
|---|
| 27 | 27 | | (A) an official school function was taking place; |
|---|
| 28 | 28 | | or |
|---|
| 29 | 29 | | (B) an event sponsored or sanctioned by the |
|---|
| 30 | 30 | | University Interscholastic League was taking place. |
|---|
| 31 | 31 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 32 | 32 | | to an offense committed on or after the effective date of this Act. |
|---|
| 33 | 33 | | An offense committed before the effective date of this Act is |
|---|
| 34 | 34 | | governed by the law in effect on the date the offense was committed, |
|---|
| 35 | 35 | | and the former law is continued in effect for that purpose. For |
|---|
| 36 | 36 | | purposes of this section, an offense was committed before the |
|---|
| 37 | 37 | | effective date of this Act if any element of the offense occurred |
|---|
| 38 | 38 | | before that date. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2023. |
