55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to increasing the criminal penalty for the offense of
88 trafficking of persons if committed at certain locations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 20A.02(b-1), Penal Code, is amended to
1111 read as follows:
1212 (b-1) An offense under this section is a felony of the first
1313 degree punishable by imprisonment in the Texas Department of
1414 Criminal Justice for life or for a term of not more than 99 years or
1515 less than 25 years if it is shown on the trial of the offense that
1616 the actor committed the offense in a location that was:
1717 (1) on the premises of or within 1,000 feet of the
1818 premises of:
1919 (A) a school;
2020 (B) a juvenile detention facility;
2121 (C) a post-adjudication secure correctional
2222 facility; or
2323 (D) a residential child-care facility, as
2424 defined by Section 42.002, Human Resources Code; or
2525 (2) on premises or within 1,000 feet of premises
2626 where:
2727 (A) an official school function was taking place;
2828 or
2929 (B) an event sponsored or sanctioned by the
3030 University Interscholastic League was taking place.
3131 SECTION 2. The change in law made by this Act applies only
3232 to an offense committed on or after the effective date of this Act.
3333 An offense committed before the effective date of this Act is
3434 governed by the law in effect on the date the offense was committed,
3535 and the former law is continued in effect for that purpose. For
3636 purposes of this section, an offense was committed before the
3737 effective date of this Act if any element of the offense occurred
3838 before that date.
3939 SECTION 3. This Act takes effect September 1, 2023.
