77 relating to access to criminal history record information by the
88 Public Utility Commission of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter F, Chapter 411, Government Code, is
1111 amended by adding Section 411.14031 to read as follows:
1212 Sec. 411.14031. ACCESS TO CRIMINAL HISTORY RECORD
1313 INFORMATION: PUBLIC UTILITY COMMISSION OF TEXAS. (a) The Public
1414 Utility Commission of Texas is entitled to obtain from the
1515 department criminal history record information maintained by the
1616 department that relates to a person required to undergo a criminal
1717 history background check under Section 12.107, Utilities Code.
1818 (b) Criminal history record information obtained under
1919 Subsection (a):
2020 (1) is for the exclusive use of the Public Utility
2121 Commission of Texas and is privileged and confidential; and
2222 (2) may not be released or disclosed to any person or
2323 agency except on court order or with the consent of the person who
2424 is the subject of the information.
2525 (c) The Public Utility Commission of Texas may destroy
2626 criminal history record information obtained under Subsection (a)
2727 after the information is used for the purposes authorized by this
2828 section.
2929 (d) This section does not prohibit the Public Utility
3030 Commission of Texas from obtaining and using criminal history
3131 record information as provided by other law.
3232 SECTION 2. Subchapter C, Chapter 12, Utilities Code, is
3333 amended by adding Section 12.107 to read as follows:
3434 Sec. 12.107. REQUIRED CRIMINAL HISTORY CHECKS FOR
3535 EMPLOYEES. (a) The commission shall perform a state and federal
3636 criminal history background check on a person who is:
3737 (1) an applicant for employment with the agency; or
3838 (2) an employee of the agency.
3939 (b) The commission shall require a person described by
4040 Subsection (a) to submit fingerprints in a form and of a quality
4141 acceptable to the Department of Public Safety and the Federal
4242 Bureau of Investigation for use in conducting a criminal history
4343 background check.
4444 (c) The commission shall obtain electronic updates from the
4545 Department of Public Safety of arrests and convictions of a person:
4646 (1) for whom the commission performs a background
4747 check under Subsection (a); and
4848 (2) who remains an employee of the commission.
4949 SECTION 3. This Act takes effect September 1, 2023.
