A BILL TO BE ENTITLED
AN ACT
relating to the procurement procedure for certain purchases related
to county roads in certain counties.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 251, Transportation Code,
is amended by adding Section 251.020 to read as follows:
Sec. 251.020. PROCUREMENT PROCEDURE FOR CERTAIN PURCHASES
RELATED TO COUNTY ROADS IN CERTAIN COUNTIES. (a) This section
applies only to a county with a population of less than 100,000.
(b) To the extent permitted by federal law, and
notwithstanding any other law, for a purchase of materials that is
related to the construction or maintenance of a county road, a
county to which this section applies is not required to use a
procurement procedure that is required by:
(1) the department;
(2) commission rule; or
(3) Subtitle B, Title 6.
SECTION 2. This Act takes effect September 1, 2023.
