| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 251, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 251.020 to read as follows: |

| 12 | 12 | | Sec. 251.020. PROCUREMENT PROCEDURE FOR CERTAIN PURCHASES |
|---|
| 13 | 13 | | RELATED TO COUNTY ROADS IN CERTAIN COUNTIES. (a) This section |
|---|
| 14 | 14 | | applies only to a county with a population of less than 100,000. |
|---|
| 15 | 15 | | (b) To the extent permitted by federal law, and |
|---|
| 16 | 16 | | notwithstanding any other law, for a purchase of materials that is |
|---|
| 17 | 17 | | related to the construction or maintenance of a county road, a |
|---|
| 18 | 18 | | county to which this section applies is not required to use a |
|---|
| 19 | 19 | | procurement procedure that is required by: |
|---|
| 20 | 20 | | (1) the department; |
|---|
| 21 | 21 | | (2) commission rule; or |
|---|
| 22 | 22 | | (3) Subtitle B, Title 6. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
