55 relating to the operation of and lighting equipment for medical
66 examiner vehicles and vehicles operated by justices of the peace in
77 certain circumstances.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 545.156, Transportation Code, is amended
1010 to read as follows:
1111 Sec. 545.156. VEHICLE APPROACHED BY AUTHORIZED EMERGENCY
1212 VEHICLE. (a) This section applies only to:
1313 (1) [On the immediate approach of] an authorized
1414 emergency vehicle using audible and visual signals that meet the
1515 requirements of Sections 547.305 and 547.702;
1616 (2) a medical examiner vehicle, as defined by Section
1717 547.751, lawfully using a visual signal in accordance with that
1818 section;
1919 (3) a vehicle operated by a justice of the peace for a
2020 purpose described by Section 547.752 and lawfully using a visual
2121 signal in accordance with that section; and
2222 (4) [, or of] a police vehicle lawfully using only an
2323 audible or visual signal.
2424 (a-1) On the immediate approach of a vehicle described by
2525 Subsection (a), an operator, unless otherwise directed by a police
2626 officer, shall:
2727 (1) yield the right-of-way;
2828 (2) immediately drive to a position parallel to and as
2929 close as possible to the right-hand edge or curb of the roadway
3030 clear of any intersection; and
3131 (3) stop and remain standing until the authorized
3232 emergency vehicle has passed.
3333 (b) This section does not exempt the operator of a [an
3434 authorized emergency] vehicle described by Subsection (a) from the
3535 duty to drive with due regard for the safety of all persons using
3636 the highway.
3737 SECTION 2. Chapter 547, Transportation Code, is amended by
3838 adding Subchapter L-1 to read as follows:
3939 SUBCHAPTER L-1. ADDITIONAL LIGHTING EQUIPMENT AUTHORIZED FOR
4040 MEDICAL EXAMINER VEHICLES AND VEHICLES OPERATED BY JUSTICES OF THE
4141 PEACE IN CERTAIN CIRCUMSTANCES
4242 Sec. 547.751. ADDITIONAL LIGHTING EQUIPMENT AUTHORIZED FOR
4343 MEDICAL EXAMINER VEHICLES. (a) In this section, "medical examiner
4444 vehicle" means a motor vehicle that is owned or leased by a
4545 governmental entity for use by a medical examiner or an employee of
4646 an office of a medical examiner in the performance of the examiner's
4747 or employee's duties relating to an inquest conducted under
4848 Subchapter B, Chapter 49, Code of Criminal Procedure.
4949 (b) A medical examiner vehicle may be equipped with either:
5050 (1) mounted signal lamps that comply with the
5151 requirements of Section 547.702(c); or
5252 (2) a signal lamp that is temporarily attached to the
5353 vehicle roof and flashes red and blue lights visible at a distance
5454 of at least 500 feet in normal sunlight.
5555 (c) The operator of a medical examiner vehicle may use the
5656 lighting equipment described by Subsection (b) only when:
5757 (1) necessary to warn other vehicle operators or
5858 pedestrians of the approach of the medical examiner vehicle; and
5959 (2) operating the vehicle in the course and scope of
6060 the operator's duties relating to an inquest conducted under
6161 Subchapter B, Chapter 49, Code of Criminal Procedure.
6262 Sec. 547.752. ADDITIONAL LIGHTING EQUIPMENT AUTHORIZED FOR
6363 VEHICLES OPERATED BY JUSTICES OF THE PEACE IN CERTAIN
6464 CIRCUMSTANCES. (a) A vehicle operated by a justice of the peace in
6565 the course and scope of the justice's duties as a coroner under
6666 Subchapter A, Chapter 49, Code of Criminal Procedure, may be
6767 equipped with either:
6868 (1) mounted signal lamps that comply with the
6969 requirements of Section 547.702(c); or
7070 (2) a signal lamp that is temporarily attached to the
7171 vehicle roof and flashes red and blue lights visible at a distance
7272 of at least 500 feet in normal sunlight.
7373 (b) A justice of the peace may use the lighting equipment
7474 described by Subsection (a) only when:
7575 (1) necessary to warn other vehicle operators or
7676 pedestrians of the approach of a vehicle operated by a justice of
7777 the peace; and
7878 (2) operating the vehicle in the course and scope of
7979 the justice's duties relating to an inquest conducted under
8080 Subchapter A, Chapter 49, Code of Criminal Procedure.
8181 SECTION 3. This Act takes effect September 1, 2023.
