| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 66, Parks and Wildlife |
|---|
| 11 | 11 | | Code, is amended by adding Section 66.0045 to read as follows: |

| 12 | 12 | | Sec. 66.0045. NONCOMMERCIAL TAKING OF SHRIMP USING |
|---|
| 13 | 13 | | MECHANICAL MEANS BY PERSON WITH DISABILITY. (a) A rule or |
|---|
| 14 | 14 | | proclamation of the commission that prohibits the noncommercial |
|---|
| 15 | 15 | | taking of shrimp using mechanical means must provide an exemption |
|---|
| 16 | 16 | | from the prohibition for a person who has a documented disability |
|---|
| 17 | 17 | | that prevents the person from taking shrimp, or substantially |
|---|
| 18 | 18 | | impairs the person's ability to take shrimp, without using |
|---|
| 19 | 19 | | mechanical means. |
|---|
| 20 | 20 | | (b) The rule or proclamation described by Subsection (a) |
|---|
| 21 | 21 | | must: |
|---|
| 22 | 22 | | (1) establish eligibility criteria and procedures for |
|---|
| 23 | 23 | | the exemption; and |
|---|
| 24 | 24 | | (2) specify the mechanical means by which shrimp may |
|---|
| 25 | 25 | | be taken under the exemption. |
|---|
| 26 | 26 | | (c) For purposes of this section, the taking of shrimp by |
|---|
| 27 | 27 | | mechanical means includes the taking of shrimp using electronic, |
|---|
| 28 | 28 | | hydraulic, or motorized means. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2023. |
