55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the identification of and prohibited cooperation by
88 state and local entities with certain federal acts that violate the
99 United States Constitution.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Title 7, Government Code, is amended by adding
1212 Chapter 794 to read as follows:
1313 CHAPTER 794. IDENTIFICATION OF AND PROHIBITED COOPERATION WITH
1414 CERTAIN UNCONSTITUTIONAL ACTS OF FEDERAL GOVERNMENT
1515 Sec. 794.001. DEFINITIONS. In this chapter:
1616 (1) "Political subdivision" has the meaning assigned
1717 by Section 791.003.
1818 (2) "State agency" has the meaning assigned by Section
1919 751.001.
2020 Sec. 794.002. REVIEW OF EXECUTIVE ORDERS. (a) On the last
2121 day of each month, the attorney general shall provide a written
2222 report to the governor, lieutenant governor, speaker of the house
2323 of representatives, and each member of the legislature that:
2424 (1) identifies each rule adopted by a federal
2525 government agency during the previous month that:
2626 (A) relates to:
2727 (i) freedom of speech;
2828 (ii) the freedom to assemble;
2929 (iii) the freedom to petition the
3030 government;
3131 (iv) the freedom of the press;
3232 (v) the free exercise of religion,
3333 including the congregating of religious practitioners;
3434 (vi) the right of the people to keep and
3535 bear arms;
3636 (vii) the regulation of the agriculture
3737 industry;
3838 (viii) the use of land;
3939 (ix) the regulation of natural resources,
4040 including oil and natural gas;
4141 (x) the regulation of education;
4242 (xi) the regulation of interscholastic,
4343 intramural, or other extracurricular sports sponsored by an
4444 institution of higher education, a school district, or a charter
4545 school; or
4646 (xii) powers not specifically granted to
4747 the federal government by the United States Constitution;
4848 (B) was adopted in response to an executive order
4949 by the president of the United States; and
5050 (C) violates the rights guaranteed to the
5151 citizens of the United States by the United States Constitution or
5252 exceeds the powers specifically granted to the federal government
5353 by the United States Constitution; and
5454 (2) provides the status of any lawsuit filed against
5555 the federal government relating to a rule identified by any report
5656 prepared under this section, including whether a court has found
5757 the rule:
5858 (A) to violate the rights guaranteed to the
5959 citizens of the United States by the United States Constitution; or
6060 (B) to exceed the powers specifically granted to
6161 the federal government by the United States Constitution.
6262 (b) The attorney general shall publish any report prepared
6363 under this section on the attorney general's website and in the
6464 Texas Register.
6565 Sec. 794.003. COOPERATION WITH UNCONSTITUTIONAL ACTS.
6666 Notwithstanding any other law, a state agency or political
6767 subdivision may not cooperate with a federal government agency in
6868 implementing an agency rule that a report published under Section
6969 794.002 indicates:
7070 (1) violates the rights guaranteed to the citizens of
7171 the United States by the United States Constitution; or
7272 (2) exceeds the powers specifically granted to the
7373 federal government by the United States Constitution.
7474 SECTION 2. This Act takes effect immediately if it receives
7575 a vote of two-thirds of all the members elected to each house, as
7676 provided by Section 39, Article III, Texas Constitution. If this
7777 Act does not receive the vote necessary for immediate effect, this
7878 Act takes effect September 1, 2023.
