55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the definition of qualified employee for purposes of
88 the enterprise zone program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2303.003(7), Government Code, is amended
1111 to read as follows:
1212 (7) "Qualified employee" means a person who:
1313 (A) is a resident of this state;
1414 (B) works for a qualified business;
1515 (C) [(B)] receives wages from the qualified
1616 business from which employment taxes are deducted; and
1717 (D) [(C)] performs at least 50 percent of the
1818 person's service for the business at the qualified business site,
1919 or if the person engages in [the transportation of goods or]
2020 services off-site, the person is assigned [reports] to the
2121 qualified business site and resides within 50 miles of the
2222 qualified business site.
2323 SECTION 2. (a) Except as provided by Subsection (b) of this
2424 section, Section 2303.003, Government Code, as amended by this Act,
2525 applies to an application for an enterprise project designation
2626 under the enterprise zone program under Chapter 2303, Government
2727 Code, as amended by this Act, that is submitted on or after the
2828 effective date of this Act. An application for an enterprise
2929 project designation under the enterprise zone program that is
3030 submitted before the effective date of this Act is governed by the
3131 law in effect on the date the application was submitted, and the
3232 former law is continued in effect for that purpose.
3333 (b) Section 2303.003(7)(D), Government Code, as added by
3434 this Act, applies to an enterprise project that is under audit or
3535 subject to audit by the comptroller of public accounts on or after
3636 the effective date of this Act.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2023.
