44 AN ACT
55 relating to the disclosure of customer information by
66 government-operated utilities.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 182.054, Utilities Code, is amended to
99 read as follows:
1010 Sec. 182.054. EXCEPTIONS. This subchapter does not
1111 prohibit a government-operated utility from disclosing personal
1212 information in a customer's account record to:
1313 (1) an official or employee of the state, a political
1414 subdivision of the state, or the United States acting in an official
1515 capacity;
1616 (2) an employee of a utility acting in connection with
1717 the employee's duties;
1818 (3) a consumer reporting agency;
1919 (4) a contractor or subcontractor approved by and
2020 providing services to the utility, the state, a political
2121 subdivision of the state, or the United States;
2222 (5) a person for whom the customer has contractually
2323 waived confidentiality for personal information; [or]
2424 (6) another entity that provides water, wastewater,
2525 sewer, gas, garbage, electricity, or drainage service for
2626 compensation;
2727 (7) another entity as necessary to facilitate the
2828 transition of customers among retail electric providers under
2929 Section 40.053 or to comply with rules, guidelines, and procedures
3030 established by an independent organization certified under Section
3131 39.151; or
3232 (8) a retail electric provider, as defined by Section
3333 31.002(17).
3434 SECTION 2. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2023.
