7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Section 182.054, Utilities Code, is amended to |
---|
9 | 9 | | read as follows: |
---|
10 | 10 | | Sec. 182.054. EXCEPTIONS. This subchapter does not |
---|
11 | 11 | | prohibit a government-operated utility from disclosing personal |
---|
12 | 12 | | information in a customer's account record to: |
---|
13 | 13 | | (1) an official or employee of the state, a political |
---|
14 | 14 | | subdivision of the state, or the United States acting in an official |
---|
15 | 15 | | capacity; |
---|
16 | 16 | | (2) an employee of a utility acting in connection with |
---|
17 | 17 | | the employee's duties; |
---|
18 | 18 | | (3) a consumer reporting agency; |
---|
19 | 19 | | (4) a contractor or subcontractor approved by and |
---|
20 | 20 | | providing services to the utility, the state, a political |
---|
21 | 21 | | subdivision of the state, or the United States; |
---|
22 | 22 | | (5) a person for whom the customer has contractually |
---|
23 | 23 | | waived confidentiality for personal information; [or] |
---|
24 | 24 | | (6) another entity that provides water, wastewater, |
---|
25 | 25 | | sewer, gas, garbage, electricity, or drainage service for |
---|
26 | 26 | | compensation; |
---|
27 | 27 | | (7) another entity as necessary to facilitate the |
---|
28 | 28 | | transition of customers among retail electric providers under |
---|
29 | 29 | | Section 40.053 or to comply with rules, guidelines, and procedures |
---|
30 | 30 | | established by an independent organization certified under Section |
---|
31 | 31 | | 39.151; or |
---|
32 | 32 | | (8) a retail electric provider, as defined by Section |
---|
33 | 33 | | 31.002(17). |
---|
34 | 34 | | SECTION 2. This Act takes effect immediately if it receives |
---|
35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
---|
36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
---|
38 | 38 | | Act takes effect September 1, 2023. |
