99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the composition of the Sexual Assault Survivors' Task
1212 Force and to compensation for task force members and certain other
1313 task force participants.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 772.0064, Government Code, is amended by
1616 amending Subsection (d) and adding Subsections (n) and (o) to read
1717 as follows:
1818 (d) The task force is composed of the following members:
1919 (1) the governor or the governor's designee;
2020 (2) a representative of each state agency that has
2121 duties relating to the prevention, investigation, or prosecution of
2222 sexual assault or other sex offenses or provides services to
2323 survivors, including:
2424 (A) the office of the attorney general; [and]
2525 (B) the Health and Human Services Commission; and
2626 (C) the Department of Family and Protective
2727 Services;
2828 (3) the executive director of the Texas Commission on
2929 Law Enforcement or the executive director's designee;
3030 (4) the presiding officer of the Texas Forensic
3131 Science Commission or the presiding officer's designee;
3232 (5) the division director of the law enforcement
3333 support division of the Texas Department of Public Safety with
3434 authority over the Crime Laboratory Service or the division
3535 director's designee;
3636 (6) the president of the Texas Association of Crime
3737 Laboratory Directors or the president's designee;
3838 (7) the president of the Texas District and County
3939 Attorney's Association or the president's designee;
4040 (8) [the president of the Texas Society of
4141 Pathologists or the president's designee;
4242 [(9)] the president of the International Association
4343 of Forensic Nurses Texas Chapter or the president's designee;
4444 (9) [(10)] the president of the statewide
4545 organization described by Section 264.409, Family Code, or the
4646 president's designee;
4747 (10) [(11)] the president of the state sexual assault
4848 coalition, as defined by Section 420.003, or the president's
4949 designee;
5050 (11) [(12)] a representative from a law enforcement
5151 agency appointed by the steering committee described by Subsection
5252 (c);
5353 (12) [(13)] a sexual assault nurse examiner appointed
5454 by the steering committee described by Subsection (c) to represent
5555 the interests of health care facilities that perform sexual assault
5656 forensic exams;
5757 (13) an adult survivor of child sexual abuse or the
5858 parent or guardian of a survivor of child sexual abuse;
5959 (14) a survivor of adult sexual assault; and
6060 (15) [(14)] other members considered appropriate by
6161 the steering committee described by Subsection (c).
6262 (n) A task force member who is not employed by a state agency
6363 or an individual invited by the governor to participate in
6464 scheduled task force meetings is entitled to:
6565 (1) a per diem in the amount provided by the General
6666 Appropriations Act for each day the member performs duties as a task
6767 force member or the individual attends a task force meeting; and
6868 (2) reimbursement for actual and necessary expenses
6969 incurred in performing duties as a member or participant of the task
7070 force, as applicable.
7171 (o) Chapter 2110 does not apply to the composition or
7272 duration of the task force or to the designation of the task force's
7373 presiding officer.
7474 SECTION 2. Section 772.0064(m), Government Code, is
7575 repealed.
7676 SECTION 3. This Act takes effect September 1, 2023.
