12 | 12 | | Force and to compensation for task force members and certain other |

14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 15 | | SECTION 1. Section 772.0064, Government Code, is amended by |
---|
16 | 16 | | amending Subsection (d) and adding Subsections (n) and (o) to read |
---|
17 | 17 | | as follows: |
---|
18 | 18 | | (d) The task force is composed of the following members: |
---|
19 | 19 | | (1) the governor or the governor's designee; |
---|
20 | 20 | | (2) a representative of each state agency that has |
---|
21 | 21 | | duties relating to the prevention, investigation, or prosecution of |
---|
22 | 22 | | sexual assault or other sex offenses or provides services to |
---|
23 | 23 | | survivors, including: |
---|
24 | 24 | | (A) the office of the attorney general; [and] |
---|
25 | 25 | | (B) the Health and Human Services Commission; and |
---|
26 | 26 | | (C) the Department of Family and Protective |
---|
27 | 27 | | Services; |
---|
28 | 28 | | (3) the executive director of the Texas Commission on |
---|
29 | 29 | | Law Enforcement or the executive director's designee; |
---|
30 | 30 | | (4) the presiding officer of the Texas Forensic |
---|
31 | 31 | | Science Commission or the presiding officer's designee; |
---|
32 | 32 | | (5) the division director of the law enforcement |
---|
33 | 33 | | support division of the Texas Department of Public Safety with |
---|
34 | 34 | | authority over the Crime Laboratory Service or the division |
---|
35 | 35 | | director's designee; |
---|
36 | 36 | | (6) the president of the Texas Association of Crime |
---|
37 | 37 | | Laboratory Directors or the president's designee; |
---|
38 | 38 | | (7) the president of the Texas District and County |
---|
39 | 39 | | Attorney's Association or the president's designee; |
---|
40 | 40 | | (8) [the president of the Texas Society of |
---|
41 | 41 | | Pathologists or the president's designee; |
---|
42 | 42 | | [(9)] the president of the International Association |
---|
43 | 43 | | of Forensic Nurses Texas Chapter or the president's designee; |

45 | 45 | | organization described by Section 264.409, Family Code, or the |

47 | 47 | | (10) [(11)] the president of the state sexual assault |

48 | 48 | | coalition, as defined by Section 420.003, or the president's |
---|
49 | 49 | | designee; |
---|
50 | 50 | | (11) [(12)] a representative from a law enforcement |
---|
51 | 51 | | agency appointed by the steering committee described by Subsection |
---|
52 | 52 | | (c); |
---|
53 | 53 | | (12) [(13)] a sexual assault nurse examiner appointed |
---|
54 | 54 | | by the steering committee described by Subsection (c) to represent |
---|
55 | 55 | | the interests of health care facilities that perform sexual assault |
---|
56 | 56 | | forensic exams; |
---|
57 | 57 | | (13) an adult survivor of child sexual abuse or the |
---|
58 | 58 | | parent or guardian of a survivor of child sexual abuse; |
---|
59 | 59 | | (14) a survivor of adult sexual assault; and |
---|
60 | 60 | | (15) [(14)] other members considered appropriate by |
---|
61 | 61 | | the steering committee described by Subsection (c). |
---|
62 | 62 | | (n) A task force member who is not employed by a state agency |
---|
63 | 63 | | or an individual invited by the governor to participate in |
---|
64 | 64 | | scheduled task force meetings is entitled to: |
---|
65 | 65 | | (1) a per diem in the amount provided by the General |
---|
66 | 66 | | Appropriations Act for each day the member performs duties as a task |
---|
67 | 67 | | force member or the individual attends a task force meeting; and |
---|
68 | 68 | | (2) reimbursement for actual and necessary expenses |
---|
69 | 69 | | incurred in performing duties as a member or participant of the task |
---|
70 | 70 | | force, as applicable. |
---|
71 | 71 | | (o) Chapter 2110 does not apply to the composition or |
---|
72 | 72 | | duration of the task force or to the designation of the task force's |
---|
73 | 73 | | presiding officer. |
---|
74 | 74 | | SECTION 2. Section 772.0064(m), Government Code, is |
---|
75 | 75 | | repealed. |
---|
76 | 76 | | SECTION 3. This Act takes effect September 1, 2023. |
