9 | 9 | | under the math and science scholars loan repayment program. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 61.9831, Education Code, is amended to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | Sec. 61.9831. LOAN REPAYMENT ASSISTANCE AUTHORIZED. The |
---|
14 | 14 | | board shall provide, in accordance with this subchapter and board |
---|
15 | 15 | | rules, assistance in the repayment of eligible student loans for |
---|
16 | 16 | | eligible persons who agree to teach mathematics or science for a |
---|
17 | 17 | | specified period in public schools [that receive federal funding |
---|
18 | 18 | | under Title I, Elementary and Secondary Education Act of 1965 (20 |
---|
19 | 19 | | U.S.C. Section 6301 et seq.)]. |
---|
20 | 20 | | SECTION 2. Sections 61.9832(a) and (c), Education Code, are |
---|
21 | 21 | | amended to read as follows: |
---|
22 | 22 | | (a) To be eligible to receive loan repayment assistance |
---|
23 | 23 | | under this subchapter, a person must: |
---|
24 | 24 | | (1) apply annually for the loan repayment assistance |
---|
25 | 25 | | in the manner prescribed by the board; |
---|
26 | 26 | | (2) be a United States citizen; |
---|
27 | 27 | | (3) have completed an undergraduate or graduate |
---|
28 | 28 | | program in mathematics or science; |
---|
29 | 29 | | (4) have a cumulative grade point average of at least |
---|
30 | 30 | | 3.0 on a four-point scale or the equivalent; |
---|
31 | 31 | | (5) be: |
---|
32 | 32 | | (A) certified under Subchapter B, Chapter 21, to |
---|
33 | 33 | | teach mathematics or science in a public school in this state; or |
---|
34 | 34 | | (B) teaching under a probationary teaching |
---|
35 | 35 | | certificate; |
---|
36 | 36 | | (6) have been employed for at least one year as a |
---|
37 | 37 | | teacher teaching mathematics or science at a public school [that |
---|
38 | 38 | | receives funding under Title I, Elementary and Secondary Education |
---|
39 | 39 | | Act of 1965 (20 U.S.C. Section 6301 et seq.)]; |
---|
40 | 40 | | (7) not be in default on any other education loan; |
---|
41 | 41 | | (8) not receive any other state or federal loan |
---|
42 | 42 | | repayment assistance, including a Teacher Education Assistance for |
---|
43 | 43 | | College and Higher Education (TEACH) Grant or teacher loan |
---|
44 | 44 | | forgiveness; |
---|
45 | 45 | | (9) enter into an agreement with the board under |
---|
46 | 46 | | Subsection (c); and |
---|
47 | 47 | | (10) comply with any other requirement adopted by the |
---|
48 | 48 | | board under this subchapter. |
---|
49 | 49 | | (c) To receive loan repayment assistance under this |
---|
50 | 50 | | subchapter, a person must enter into an agreement with the board |
---|
51 | 51 | | that includes the following provisions: |
---|
52 | 52 | | (1) the person will accept an offer of full-time |
---|
53 | 53 | | employment to teach mathematics or science, as applicable based on |
---|
54 | 54 | | the person's certification, in a public school [that receives |
---|
55 | 55 | | funding under Title I, Elementary and Secondary Education Act of |
---|
56 | 56 | | 1965 (20 U.S.C. Section 6301 et seq.)]; |
---|
57 | 57 | | (2) the person will complete four consecutive years of |
---|
58 | 58 | | employment in any public school as a full-time classroom teacher |
---|
59 | 59 | | [in a school described by Subdivision (1)] whose primary duty is to |
---|
60 | 60 | | teach mathematics or science, as applicable, based on the person's |
---|
61 | 61 | | certification; |
---|
62 | 62 | | (3) beginning with the school year immediately |
---|
63 | 63 | | following the last of the four consecutive school years described |
---|
64 | 64 | | by Subdivision (2), the person will complete an additional number |
---|
65 | 65 | | of consecutive school years teaching in any public school in this |
---|
66 | 66 | | state, as prescribed by board rule; and |
---|
67 | 67 | | (4) the person acknowledges the conditional nature of |
---|
68 | 68 | | the loan repayment assistance. |
---|
69 | 69 | | SECTION 3. Section 61.9839(a), Education Code, is amended |
---|
70 | 70 | | to read as follows: |
---|
71 | 71 | | (a) Subject to Sections 61.9833(b) and 61.9838(c), an [An] |
---|
72 | 72 | | eligible person may continue to receive the same amount of loan |
---|
73 | 73 | | repayment assistance received during the first four consecutive |
---|
74 | 74 | | years of teaching service required under Section 61.9832(c)(2) if |
---|
75 | 75 | | the person continues to teach in a public school in accordance with |
---|
76 | 76 | | board rules for the prescribed number of consecutive school years |
---|
77 | 77 | | occurring immediately after those [that receives funding under |
---|
78 | 78 | | Title I, Elementary and Secondary Education Act of 1965 (20 U.S.C. |
---|
79 | 79 | | Section 6301 et seq.), after the] first four years [of teaching |
---|
80 | 80 | | service required under Section 61.9832(c)(2)]. |
---|
81 | 81 | | SECTION 4. Section 61.9839(b), Education Code, is repealed. |
---|
82 | 82 | | SECTION 5. (a) As soon as practicable after the effective |
---|
83 | 83 | | date of this Act, the Texas Higher Education Coordinating Board |
---|
84 | 84 | | shall adopt rules necessary to administer Sections 61.9831, |
---|
85 | 85 | | 61.9832, and 61.9839, Education Code, as amended by this Act. |
---|
86 | 86 | | (b) Sections 61.9831, 61.9832, and 61.9839, Education Code, |
---|
87 | 87 | | as amended by this Act, apply only to a loan repayment assistance |
---|
88 | 88 | | agreement entered into under Subchapter KK, Chapter 61, Education |
---|
89 | 89 | | Code, on or after the effective date of this Act. A loan repayment |
---|
90 | 90 | | assistance agreement entered into before the effective date of this |
---|
91 | 91 | | Act is governed by the law in effect immediately before that date, |
---|
92 | 92 | | and the former law is continued in effect for that purpose. |
---|
93 | 93 | | SECTION 6. This Act takes effect September 1, 2023. |
