55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the sale of distilled spirits at a temporary location by
88 the holder of a distiller's and rectifier's permit.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 14.01(a), Alcoholic Beverage Code, is
1111 amended to read as follows:
1212 (a) The holder of a distiller's and rectifier's permit may:
1313 (1) manufacture distilled spirits;
1414 (2) rectify, purify, and refine distilled spirits and
1515 wines;
1616 (3) mix wines, distilled spirits, or other liquors;
1717 (4) bottle, label, and package the permit holder's
1818 finished products;
1919 (5) sell the finished products in this state to
2020 holders of wholesaler's permits and to qualified persons outside
2121 the state;
2222 (6) purchase distilled spirits, to be used only for
2323 manufacturing or rectification purposes, from holders of
2424 nonresident seller's permits or distiller's and rectifier's
2525 permits;
2626 (7) dispense free distilled spirits for consumption on
2727 the permitted premises under Section 14.04;
2828 (8) sell bulk alcohol produced by the permit holder
2929 for purposes described by Section 38.01; and
3030 (9) sell distilled spirits to ultimate consumers under
3131 Section 14.04, [or] 14.05, or 14.09.
3232 SECTION 2. Chapter 14, Alcoholic Beverage Code, is amended
3333 by adding Section 14.09 to read as follows:
3434 Sec. 14.09. SALES AT TEMPORARY LOCATION. (a) The holder of
3535 a distiller's and rectifier's permit may sell distilled spirits at a
3636 civic or distilled spirits festival, farmers' market, celebration,
3737 or similar event promoting culture and tourism in this state.
3838 (b) The holder of a distiller's and rectifier's permit may
3939 not offer distilled spirits for sale under this section on more than
4040 four consecutive days at the same location.
4141 (c) The commission shall adopt rules to implement this
4242 section, including rules that:
4343 (1) require the permit holder to notify the commission
4444 of the dates on which and location where the permit holder will
4545 temporarily offer distilled spirits for sale under this section;
4646 (2) establish a procedure to verify the wet or dry
4747 status of the location where the permit holder intends to
4848 temporarily sell distilled spirits under this section;
4949 (3) detail the circumstances when a permit holder may
5050 temporarily sell distilled spirits under this section with just a
5151 notification to the commission and the circumstances that require
5252 the commission's preapproval before a permit holder may temporarily
5353 sell distilled spirits under this section; and
5454 (4) require the permit holder to provide any other
5555 information the commission determines necessary.
5656 (d) The provisions of this code applicable to the sale of
5757 distilled spirits on the permitted premises of the holder of a
5858 distiller's and rectifier's permit apply to the sale of distilled
5959 spirits under this section.
6060 SECTION 3. This Act takes effect September 1, 2023.
