55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of dyed diesel fuel to operate a motor vehicle
88 during and for a limited period following certain disasters.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 162.235, Tax Code, is amended by adding
1111 Subsection (c) to read as follows:
1212 (c) Notwithstanding Subsection (a), a person who purchases
1313 dyed motor fuel and furnishes to the licensed supplier or
1414 distributor under Section 162.206(a) a signed statement that
1515 includes an end user number issued by the comptroller may operate a
1616 motor vehicle on a public highway in this state with that dyed motor
1717 fuel in the fuel supply tank of the motor vehicle during a period
1818 beginning on the date a state of disaster is declared under Section
1919 418.014, Government Code, due to a fire, flood, earthquake,
2020 tornado, hurricane, storm, or energy emergency and ending on the
2121 30th day after the declaration expires or otherwise terminates, if
2222 the motor vehicle is operated:
2323 (1) in the area designated a disaster area by the
2424 disaster declaration; or
2525 (2) in an area other than the area described by
2626 Subdivision (1) if the dyed motor fuel was placed in the fuel supply
2727 tank of the motor vehicle in the area described by that subdivision.
2828 SECTION 2. The change in law made by this Act applies only
2929 to conduct that occurs on or after the effective date of this Act.
3030 Conduct that occurred before the effective date of this Act is
3131 governed by the law in effect on the date the conduct occurred, and
3232 the former law is continued in effect for that purpose. For
3333 purposes of this section, conduct occurred before the effective
3434 date of this Act if any element of the conduct occurred before that
3535 date.
3636 SECTION 3. This Act takes effect September 1, 2023.
