66 relating to the modification of certain orders in a suit affecting

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 156, Family Code, is
1010 amended by adding Section 156.1011 to read as follows:
1111 Sec. 156.1011. REQUIRED FINDINGS FOR CERTAIN
1212 MODIFICATIONS; PARENTAL PRESUMPTION. (a) In a suit seeking to
1313 modify an order appointing a child's parent as the child's managing
1414 conservator, the court may not remove the parent as the child's
1515 managing conservator unless the court finds that the parent's
1616 continued appointment would not be in the best interest of the child
1717 because the continued appointment would significantly impair the
1818 child's physical health or emotional development.
1919 (b) In a suit by a nonparent seeking a modification that has
2020 the effect of creating a designation, or changing the designation
2121 of the person who has the exclusive right to designate the primary
2222 residence of the child, if one or both of the child's parents were
2323 named in the final order as a managing conservator of the child, the
2424 court shall designate or maintain the designation of a parent
2525 managing conservator as the person with the exclusive right to
2626 designate the child's primary residence unless the court finds that
2727 the designation would significantly impair the child's physical
2828 health or emotional development.
2929 (c) Section 153.373 applies in a suit for modification under
3030 this subchapter.
3131 SECTION 2. The change in law made by this Act applies to a
3232 suit for modification that is pending in a trial court on the
3333 effective date of this Act or that is filed on or after the
3434 effective date of this Act.
3535 SECTION 3. This Act takes effect September 1, 2023.
