55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study by the Texas Education Agency regarding
88 recommended standards for school district facility maintenance and
99 custodial services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. DEFINITION. In this Act, "agency" means the
1212 Texas Education Agency.
1313 SECTION 2. STUDY REGARDING RECOMMENDED STANDARDS FOR
1414 MAINTENANCE AND CUSTODIAL SERVICES. (a) The agency shall conduct a
1515 study regarding recommended standards for school district
1616 maintenance of facilities and custodial services, including a
1717 standard for appropriate custodial workloads to adequately
1818 maintain a school district's facilities.
1919 (b) In conducting the study, the agency shall consider:
2020 (1) the square footage of a typical elementary,
2121 middle, and high school;
2222 (2) the square footage of administrative and district
2323 facilities other than instructional facilities in a typical school
2424 district;
2525 (3) appropriate levels of custodial service to provide
2626 for proper maintenance of school district facilities; and
2727 (4) the time required for different levels of
2828 custodial service based on different numbers of custodial employees
2929 and resources.
3030 (c) The study must identify:
3131 (1) the maintenance and custodial staff needed to
3232 adequately meet a typical school district's needs;
3333 (2) the tasks required to be completed by maintenance
3434 and custodial staff, including time estimates for completion of
3535 each task by an adequately equipped maintenance and custodial
3636 staff; and
3737 (3) any additional funding or other resources, if any,
3838 needed by school districts to meet the standards recommended by the
3939 study for school district maintenance of facilities and custodial
4040 services.
4141 SECTION 3. REPORT TO LEGISLATURE. Not later than December
4242 1, 2024, the agency shall submit a report to the legislature that
4343 includes the results of the study conducted under Section 2 of this
4444 Act and any associated recommendations.
4545 SECTION 4. EXPIRATION. This Act expires September 1, 2025.
4646 SECTION 5. EFFECTIVE DATE. This Act takes effect
4747 immediately if it receives a vote of two-thirds of all the members
4848 elected to each house, as provided by Section 39, Article III, Texas
4949 Constitution. If this Act does not receive the vote necessary for
5050 immediate effect, this Act takes effect September 1, 2023.
