66 relating to a notification requirement if a public school does not
77 have a nurse, school counselor, or librarian assigned to the school

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 25, Education Code, is
1111 amended by adding Section 25.096 to read as follows:
1212 Sec. 25.096. PARENTAL NOTIFICATION CONCERNING NURSES,
1313 SCHOOL COUNSELORS, AND LIBRARIANS. (a) In this section:
1414 (1) "Librarian" means a person certified as a
1515 librarian under Subchapter B, Chapter 21.
1616 (2) "Nurse" means a person licensed under Chapter 301,
1717 Occupations Code.
1818 (3) "School counselor" means a person certified as a
1919 school counselor under Subchapter B, Chapter 21.
2020 (b) Except as otherwise provided by Subsection (i), a public
2121 school, including an open-enrollment charter school, that does not
2222 have a full-time nurse, school counselor, or librarian or the
2323 equivalent of a full-time nurse, school counselor, or librarian
2424 assigned to be present at the school for more than 30 consecutive
2525 instructional days during the same school year shall provide
2626 written notice of the absence to the parent of or other person
2727 standing in parental relation to each student enrolled in the
2828 school.
2929 (c) A school has the equivalent of a full-time nurse under
3030 Subsection (b) if the school has two or more nurses assigned to the
3131 school and all regular student instructional hours at the campus
3232 during the regular school day are covered by the assignment of at
3333 least one nurse.
3434 (d) A school has the equivalent of a full-time school
3535 counselor under Subsection (b) if the school has two or more school
3636 counselors assigned to the school and all regular student
3737 instructional hours at the campus during the regular school day are
3838 covered by the assignment of at least one school counselor.
3939 (e) A school has the equivalent of a full-time librarian
4040 under Subsection (b) if the school has two or more librarians
4141 assigned to the school and all regular student instructional hours
4242 at the campus during the regular school day are covered by the
4343 assignment of at least one librarian.
4444 (f) The principal of the school shall provide the notice
4545 required by Subsection (b) not later than the 30th instructional
4646 day after the first day the school does not have a full-time nurse,
4747 school counselor, or librarian assigned to be present at the
4848 school.
4949 (g) The school shall:
5050 (1) make a good faith effort to ensure that the notice
5151 required by this section is provided in a bilingual form to any
5252 parent or other person standing in parental relation whose primary
5353 language is not English; and
5454 (2) retain a copy of any notice provided under this
5555 section.
5656 (h) A school may satisfy the notice requirement under
5757 Subsection (f) by posting the notice on the school's Internet
5858 website. Notice posted under this subsection must be accessible
5959 from the home page of the Internet website by use of not more than
6060 three links.
6161 (i) This section does not apply to a school district or
6262 open-enrollment charter school with a student enrollment of less
6363 than 10,000 students.
6464 SECTION 2. This Act applies beginning with the 2023-2024
6565 school year.
6666 SECTION 3. This Act takes effect immediately if it receives
6767 a vote of two-thirds of all the members elected to each house, as
6868 provided by Section 39, Article III, Texas Constitution. If this
6969 Act does not receive the vote necessary for immediate effect, this
7070 Act takes effect September 1, 2023.
