55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the taking of wildlife by an employee of the Parks and
88 Wildlife Department or by a person or agent of the person on the
99 person's property.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 12.013, Parks and Wildlife Code, is
1212 amended by amending Subsection (a) and adding Subsections (c), (d),
1313 (e), and (f) to read as follows:
1414 (a) An employee of the department acting within the scope of
1515 the employee's authority may possess, take, transport, release, and
1616 manage any of the wildlife and fish in this state for public safety,
1717 investigation, propagation, distribution, education, disease
1818 diagnosis or prevention, or scientific purposes.
1919 (c) An employee of the department acting within the scope of
2020 the employee's authority may discharge a firearm on a public road or
2121 right-of-way to humanely dispatch injured wildlife.
2222 (d) Except as provided by Subsection (e), a person or agent
2323 of the person may take wildlife on the person's property if the
2424 person has written authorization from the department that
2525 specifies:
2626 (1) the type of wildlife that may be taken;
2727 (2) the number of wildlife that may be taken; and
2828 (3) the period during which the wildlife may be taken.
2929 (e) Subsection (d) does not apply to a person or agent who is
3030 a department employee.
3131 (f) The commission may adopt rules to implement this
3232 section.
3333 SECTION 2. Section 62.0031(b), Parks and Wildlife Code, is
3434 amended to read as follows:
3535 (b) This section does not apply to:
3636 (1) the trapping of a raptor for educational or
3737 sporting purposes as provided by Chapter 49; or
3838 (2) an employee of the department taking wildlife as
3939 provided by Section 12.013(c).
4040 SECTION 3. Section 42.01, Penal Code, is amended by adding
4141 Subsection (e-1) to read as follows:
4242 (e-1) It is an exception to the application of Subsection
4343 (a)(9) that, at the time the person engaged in conduct prohibited
4444 under that subdivision, the person was an employee of the Parks and
4545 Wildlife Department acting within the scope of the employee's
4646 authority under Section 12.013(c), Parks and Wildlife Code.
4747 SECTION 4. The change in law made by this Act applies only
4848 to an offense committed on or after the effective date of this Act.
4949 An offense committed before the effective date of this Act is
5050 governed by the law in effect on the date the offense was committed,
5151 and the former law is continued in effect for that purpose. For
5252 purposes of this section, an offense was committed before the
5353 effective date of this Act if any element of the offense occurred
5454 before that date.
5555 SECTION 5. This Act takes effect September 1, 2023.
