44 AN ACT
55 relating to prosecution of certain criminal offenses prohibiting
66 sexually explicit visual material involving children.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 43.26, Penal Code, is amended by adding
99 Subsection (i) to read as follows:
1010 (i) For purposes of conduct prohibited under this section,
1111 visual material to which that conduct applies includes a depiction
1212 of a child:
1313 (1) who is recognizable as an actual person by the
1414 person's face, likeness, or other distinguishing characteristic,
1515 such as a unique birthmark or other recognizable feature; and
1616 (2) whose image as a child younger than 18 years of age
1717 was used in creating, adapting, or modifying the visual material,
1818 including computer-generated visual material that was created,
1919 adapted, or modified using an artificial intelligence application
2020 or other computer software.
2121 SECTION 2. Section 43.261, Penal Code, is amended by adding
2222 Subsection (b-1) to read as follows:
2323 (b-1) For purposes of conduct prohibited under Subsection
2424 (b), visual material to which that conduct applies includes a
2525 depiction of a minor:
2626 (1) who is recognizable as an actual person by the
2727 person's face, likeness, or other distinguishing characteristic,
2828 such as a unique birthmark or other recognizable feature; and
2929 (2) whose image as a minor was used in creating,
3030 adapting, or modifying the visual material, including
3131 computer-generated visual material that was created, adapted, or
3232 modified using an artificial intelligence application or other
3333 computer software.
3434 SECTION 3. Section 43.262, Penal Code, is amended by adding
3535 Subsection (b-1) to read as follows:
3636 (b-1) For purposes of conduct prohibited under Subsection
3737 (b), visual material to which that conduct applies includes a
3838 depiction of a child:
3939 (1) who is recognizable as an actual person by the
4040 person's face, likeness, or other distinguishing characteristic,
4141 such as a unique birthmark or other recognizable feature; and
4242 (2) whose image as a child younger than 18 years of age
4343 was used in creating, adapting, or modifying the visual material,
4444 including computer-generated visual material that was created,
4545 adapted, or modified using an artificial intelligence application
4646 or other computer software.
4747 SECTION 4. The changes in law made by this Act apply only to
4848 an offense committed on or after the effective date of this Act. An
4949 offense committed before the effective date of this Act is governed
5050 by the law in effect on the date the offense was committed, and the
5151 former law is continued in effect for that purpose. For purposes of
5252 this section, an offense was committed before the effective date of
5353 this Act if any element of the offense was committed before that
5454 date.
5555 SECTION 5. This Act takes effect September 1, 2023.
