| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 2001, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 2001.008 to read as follows: |
|---|
| 13 | 13 | | Sec. 2001.008. EFFECT OF AMENDMENT OF DOCUMENTS |
|---|
| 14 | 14 | | INCORPORATED BY REFERENCE ON CERTAIN RULES. A state agency in the |
|---|
| 15 | 15 | | manner provided by this chapter shall readopt, readopt with |
|---|
| 16 | 16 | | amendments, or repeal a previously adopted rule if: |
|---|
| 17 | 17 | | (1) the rule implements, interprets, or prescribes a |
|---|
| 18 | 18 | | law or policy of this state that incorporates by reference a |
|---|
| 19 | 19 | | document that is not another law or policy of this state; and |
|---|
| 20 | 20 | | (2) as a result of an amendment to the document that is |
|---|
| 21 | 21 | | incorporated by reference into the law or policy the rule |
|---|
| 22 | 22 | | implements, interprets, or prescribes, the rule would: |
|---|
| 23 | 23 | | (A) allow the agency to expand its regulatory |
|---|
| 24 | 24 | | authority over a matter that involves a major question of state |
|---|
| 25 | 25 | | policy; or |
|---|
| 26 | 26 | | (B) impose a greater economic burden on persons |
|---|
| 27 | 27 | | required to comply with the rule or on the economy of this state. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect September 1, 2023. |
