| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 51.9273 to read as follows: |
|---|
| 13 | 13 | | Sec. 51.9273. CERTAIN PARTNERSHIPS TO CONSTRUCT STUDENT |
|---|
| 14 | 14 | | HOUSING FACILITIES PROHIBITED. (a) In this section, "institution |
|---|
| 15 | 15 | | of higher education" has the meaning assigned by Section 61.003. |
|---|
| 16 | 16 | | (b) An institution of higher education may not enter into a |
|---|
| 17 | 17 | | contract to partner with a private entity to construct a student |
|---|
| 18 | 18 | | housing facility if the entity has a pending action or lien against |
|---|
| 19 | 19 | | the entity or entity's property relating to a claim for nonpayment |
|---|
| 20 | 20 | | of a contractor, subcontractor, or vendor. |
|---|
| 21 | 21 | | SECTION 2. Section 51.9273, Education Code, as added by |
|---|
| 22 | 22 | | this Act, applies only to a contract entered into on or after the |
|---|
| 23 | 23 | | effective date of this Act. A contract entered into before the |
|---|
| 24 | 24 | | effective date of this Act is governed by the law in effect on the |
|---|
| 25 | 25 | | date the contract was entered into, and the former law is continued |
|---|
| 26 | 26 | | in effect for that purpose. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2023. |
