55 relating to teacher requirements for high quality prekindergarten
66 programs.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 29.167, Education Code, is amended by
99 amending Subsections (b) and (d) and adding Subsections (b-1),
1010 (b-2), and (b-3) to read as follows:
1111 (b) Each teacher for a prekindergarten program class must:
1212 (1) be certified under Subchapter B, Chapter 21; and
1313 (2) have one of the following additional
1414 qualifications:
1515 (A) an associate or baccalaureate degree in early
1616 childhood education or a related field;
1717 (B) a Child Development Associate (CDA)
1818 credential or another early childhood education credential
1919 approved by the agency;
2020 (C) [(B)] certification offered through a
2121 training center accredited by Association Montessori
2222 Internationale or through the Montessori Accreditation Council for
2323 Teacher Education;
2424 (D) [(C)] at least eight years' experience of
2525 teaching in a nationally accredited child care program or a Texas
2626 Rising Star Program;
2727 (E) [(D)] be employed as a prekindergarten
2828 teacher in a school district that has received approval from the
2929 commissioner for the district's prekindergarten-specific
3030 instructional training plan that the teacher uses in the teacher's
3131 prekindergarten classroom; or
3232 (F) [(E)] an equivalent qualification.
3333 (b-1) Notwithstanding Subsection (b), each teacher for a
3434 prekindergarten class provided by an entity with which a school
3535 district contracts to provide a prekindergarten program must:
3636 (1) be supervised by a person who meets the
3737 requirements under Subsection (b); and
3838 (2) have one of the following qualifications:
3939 (A) at least two years' experience of teaching in
4040 a nationally accredited child care program or a Texas Rising Star
4141 Program and:
4242 (i) a Child Development Associate (CDA)
4343 credential or another early childhood education credential
4444 approved by the agency; or
4545 (ii) certification offered through a
4646 training center accredited by Association Montessori
4747 Internationale or through the Montessori Accreditation Council for
4848 Teacher Education; or
4949 (B) a qualification described by Subsection
5050 (b)(2)(A), (D), (E), or (F).
5151 (b-2) A person who supervises a prekindergarten program
5252 provided by an entity with which a school district contracts for
5353 that purpose may supervise multiple prekindergarten classrooms to:
5454 (1) ensure programmatic compliance; and
5555 (2) support:
5656 (A) classroom instruction;
5757 (B) the developmental needs of students; and
5858 (C) continuous quality improvement, including
5959 professional development.
6060 (b-3) Subsections (b-1) and (b-2) and this subsection
6161 expire September 1, 2029.
6262 (d) A school district or an entity with which the district
6363 contracts to provide a prekindergarten program must attempt to
6464 maintain an average ratio in any prekindergarten program class of
6565 not less than one qualified [certified] teacher or teacher's aide
6666 for each 11 students.
6767 SECTION 2. This Act applies beginning with the 2023-2024
6868 school year.
6969 SECTION 3. This Act takes effect immediately if it receives
7070 a vote of two-thirds of all the members elected to each house, as
7171 provided by Section 39, Article III, Texas Constitution. If this
7272 Act does not receive the vote necessary for immediate effect, this
7373 Act takes effect September 1, 2023.

8181 houses; and that the House adopted the conference committee report
8282 on H.B. No. 2729 on May 28, 2023, by the following vote: Yeas 93,
8383 Nays 47, 2 present, not voting.
