| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 402.042(b), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (b) An opinion may be requested by: |
|---|
| 13 | 13 | | (1) the governor; |
|---|
| 14 | 14 | | (2) the head of a department of state government; |
|---|
| 15 | 15 | | (3) a head or board of a penal institution; |
|---|
| 16 | 16 | | (4) a head or board of an eleemosynary institution; |
|---|
| 17 | 17 | | (5) the head of a state board; |
|---|
| 18 | 18 | | (6) a regent or trustee of a state educational |
|---|
| 19 | 19 | | institution; |
|---|
| 20 | 20 | | (7) a committee of a house of the legislature; |
|---|
| 21 | 21 | | (8) a county auditor authorized by law; [or] |
|---|
| 22 | 22 | | (9) the chairman of the governing board of a river |
|---|
| 23 | 23 | | authority; or |
|---|
| 24 | 24 | | (10) a member of the State Board of Education. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2023. |
