| 7 | 7 | | relating to the appointment of members to policy boards of certain |

| 8 | 8 | | metropolitan planning organizations. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 472, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 472.037 to read as follows: |
|---|
| 12 | 12 | | Sec. 472.037. APPOINTMENT OF MEMBERS TO CERTAIN POLICY |
|---|
| 13 | 13 | | BOARDS. (a) This section applies only to a metropolitan planning |
|---|
| 14 | 14 | | organization that serves a county with a population of more than |
|---|
| 15 | 15 | | four million. |
|---|
| 16 | 16 | | (b) Counties served by a metropolitan planning organization |
|---|
| 17 | 17 | | described by Subsection (a) shall appoint voting members to the |
|---|
| 18 | 18 | | organization's policy board as follows: |
|---|
| 19 | 19 | | (1) a county with a population of four million or more |
|---|
| 20 | 20 | | shall appoint two members; |
|---|
| 21 | 21 | | (2) a county with a population of less than four |
|---|
| 22 | 22 | | million but more than 45,000 shall appoint one member; and |
|---|
| 23 | 23 | | (3) a county with a population of 45,000 or less, |
|---|
| 24 | 24 | | together with an adjacent county with a population of 45,000 or |
|---|
| 25 | 25 | | less, shall jointly appoint one member. |
|---|
| 26 | 26 | | (c) Municipalities served by a metropolitan planning |
|---|
| 27 | 27 | | organization described by Subsection (a) shall appoint voting |
|---|
| 28 | 28 | | members to the organization's policy board as follows: |
|---|
| 29 | 29 | | (1) a municipality with a population of two million or |
|---|
| 30 | 30 | | more shall appoint two members; and |
|---|
| 31 | 31 | | (2) a municipality with a population of less than two |
|---|
| 32 | 32 | | million but more than 25,000 shall appoint one member. |
|---|
| 33 | 33 | | (d) The department shall appoint three members to the policy |
|---|
| 34 | 34 | | board of a metropolitan planning organization described by |
|---|
| 35 | 35 | | Subsection (a). |
|---|
| 36 | 36 | | (e) A metropolitan transit authority or rail district |
|---|
| 37 | 37 | | served by a metropolitan planning organization described by |
|---|
| 38 | 38 | | Subsection (a) shall appoint one voting member to the |
|---|
| 39 | 39 | | organization's policy board. |
|---|
| 40 | 40 | | (f) A port authority located in a municipality with a |
|---|
| 41 | 41 | | population of more than two million that is served by a metropolitan |
|---|
| 42 | 42 | | planning organization described by Subsection (a) shall appoint one |
|---|
| 43 | 43 | | voting member to the organization's policy board. |
|---|
| 44 | 44 | | (g) The governor shall appoint two voting members to the |
|---|
| 45 | 45 | | policy board of a metropolitan planning organization described by |
|---|
| 46 | 46 | | Subsection (a). |
|---|
| 47 | 47 | | (h) Each member of a policy board of a metropolitan planning |
|---|
| 48 | 48 | | organization described by Subsection (a) is entitled to one vote. |
|---|
| 49 | 49 | | SECTION 2. This Act takes effect September 1, 2023. |
