66 AN ACT
77 relating to the appointment of members to policy boards of certain
88 metropolitan planning organizations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 472, Transportation Code,
1111 is amended by adding Section 472.037 to read as follows:
1212 Sec. 472.037. APPOINTMENT OF MEMBERS TO CERTAIN POLICY
1313 BOARDS. (a) This section applies only to a metropolitan planning
1414 organization that serves a county with a population of more than
1515 four million.
1616 (b) Counties served by a metropolitan planning organization
1717 described by Subsection (a) shall appoint voting members to the
1818 organization's policy board as follows:
1919 (1) a county with a population of four million or more
2020 shall appoint two members;
2121 (2) a county with a population of less than four
2222 million but more than 45,000 shall appoint one member; and
2323 (3) a county with a population of 45,000 or less,
2424 together with an adjacent county with a population of 45,000 or
2525 less, shall jointly appoint one member.
2626 (c) Municipalities served by a metropolitan planning
2727 organization described by Subsection (a) shall appoint voting
2828 members to the organization's policy board as follows:
2929 (1) a municipality with a population of two million or
3030 more shall appoint two members; and
3131 (2) a municipality with a population of less than two
3232 million but more than 25,000 shall appoint one member.
3333 (d) The department shall appoint three members to the policy
3434 board of a metropolitan planning organization described by
3535 Subsection (a).
3636 (e) A metropolitan transit authority or rail district
3737 served by a metropolitan planning organization described by
3838 Subsection (a) shall appoint one voting member to the
3939 organization's policy board.
4040 (f) A port authority located in a municipality with a
4141 population of more than two million that is served by a metropolitan
4242 planning organization described by Subsection (a) shall appoint one
4343 voting member to the organization's policy board.
4444 (g) The governor shall appoint two voting members to the
4545 policy board of a metropolitan planning organization described by
4646 Subsection (a).
4747 (h) Each member of a policy board of a metropolitan planning
4848 organization described by Subsection (a) is entitled to one vote.
4949 SECTION 2. This Act takes effect September 1, 2023.
