| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 211, Local Government |
|---|
| 11 | 11 | | Code, is amended by adding Section 211.0073 to read as follows: |
|---|
| 12 | 12 | | Sec. 211.0073. NOTICE SIGN REQUIREMENT FOR CERTAIN ZONING |
|---|
| 13 | 13 | | CHANGES IN HOME-RULE MUNICIPALITIES. (a) Not later than the 10th |
|---|
| 14 | 14 | | day before the date the zoning commission of a home-rule |
|---|
| 15 | 15 | | municipality holds a hearing on a proposed change in zoning |
|---|
| 16 | 16 | | classification that does not apply to the whole municipality, the |
|---|
| 17 | 17 | | zoning commission shall post a notice sign in accordance with this |
|---|
| 18 | 18 | | section on: |
|---|
| 19 | 19 | | (1) the property affected by the change; or |
|---|
| 20 | 20 | | (2) a public right-of-way for a change initiated by |
|---|
| 21 | 21 | | the municipality that affects multiple properties. |
|---|
| 22 | 22 | | (b) The zoning commission may determine the notice sign's |
|---|
| 23 | 23 | | size, contents, duration of posting, and removal. |
|---|
| 24 | 24 | | (c) The zoning commission may elect to provide, maintain, |
|---|
| 25 | 25 | | and pay for a notice sign under this section or require an applicant |
|---|
| 26 | 26 | | for a change in zoning classification to provide, maintain, and pay |
|---|
| 27 | 27 | | for the sign. |
|---|
| 28 | 28 | | (d) Notice requirements prescribed under this section are |
|---|
| 29 | 29 | | in addition to notice required by Section 211.007. |
|---|
| 30 | 30 | | SECTION 2. Section 211.0073, Local Government Code, as |
|---|
| 31 | 31 | | added by this Act, applies only to a proposal to change a zoning |
|---|
| 32 | 32 | | classification made on or after the effective date of this Act. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2023. |
