55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of political contributions by a candidate or
88 officeholder for child-care expenses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 253.035(d), Election Code, is amended to
1111 read as follows:
1212 (d) In this section, "personal use" means a use that
1313 primarily furthers individual or family purposes not connected with
1414 the performance of duties or activities as a candidate for or holder
1515 of a public office. The term does not include:
1616 (1) payments made to defray ordinary and necessary
1717 expenses incurred in connection with activities as a candidate or
1818 in connection with the performance of duties or activities as a
1919 public officeholder, including payment of:
2020 (A) rent, utility, and other reasonable housing
2121 or household expenses incurred in maintaining a residence in Travis
2222 County by members of the legislature who do not ordinarily reside in
2323 Travis County, but excluding payments prohibited under Section
2424 253.038; or
2525 (B) child-care expenses for a child of the
2626 candidate or officeholder made in accordance with Section 253.0352;
2727 or
2828 (2) payments of federal income taxes due on interest
2929 and other income earned on political contributions.
3030 SECTION 2. Subchapter B, Chapter 253, Election Code, is
3131 amended by adding Section 253.0352 to read as follows:
3232 Sec. 253.0352. CHILD-CARE EXPENSES. A candidate or an
3333 officeholder may use political contributions to pay for child-care
3434 expenses incurred for a child of the candidate or officeholder,
3535 including payment to a family member other than the child's parent,
3636 legal guardian, or conservator.
3737 SECTION 3. The changes in law made by this Act apply only to
3838 payment of a child-care expense incurred by a candidate or
3939 officeholder on or after the effective date of this Act. The
4040 payment of a child-care expense incurred by a candidate or
4141 officeholder before the effective date of this Act is governed by
4242 the law in effect on the date the payment was made, and the former
4343 law is continued in effect for that purpose.
4444 SECTION 4. This Act takes effect September 1, 2023.
