55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to funding and activities of the Texas Produced Water
88 Consortium.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 109.205(c), Education Code, is repealed.
1111 SECTION 2. (a) In this section, "consortium" means the
1212 Texas Produced Water Consortium established by Subchapter E,
1313 Chapter 109, Education Code.
1414 (b) Not later than October 1, 2023, the consortium shall
1515 select a pilot project or program for consideration and
1616 implementation.
1717 (c) Not later than October 1, 2024, the consortium shall
1818 submit to the legislature a report regarding:
1919 (1) the status of the pilot project or program
2020 selected under Subsection (b) of this section; and
2121 (2) any suggested policy, regulatory, or legislative
2222 changes resulting from an analysis of the implementation of the
2323 pilot project or program selected under Subsection (b) of this
2424 section.
2525 (d) The consortium is required to implement a provision of
2626 this section only if the legislature appropriates money
2727 specifically for that purpose. If the legislature does not
2828 appropriate money specifically for that purpose, the consortium
2929 may, but is not required to, implement the provision using other
3030 money available to the consortium for that purpose.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2023.
