66 AN ACT
77 relating to the regulation by a municipality or property owners'
88 association of food production on single-family residential lots.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 217, Local Government Code, is amended
1111 by adding Subchapter Z to read as follows:
1212 SUBCHAPTER Z. MISCELLANEOUS PROVISIONS
1313 Sec. 217.901. FOOD PRODUCTION ALLOWED ON SINGLE-FAMILY
1414 RESIDENTIAL LOT. (a) Notwithstanding any other law and except as
1515 provided by this section, a municipality may not adopt or enforce an
1616 ordinance that prohibits any of the following activities on a
1717 single-family residential lot:
1818 (1) growing fruits and vegetables; or
1919 (2) raising or keeping:
2020 (A) six or fewer domestic fowl; or
2121 (B) six or fewer adult rabbits.
2222 (b) A municipality may impose reasonable regulations on the
2323 growing of fruits and vegetables on a single-family residential lot
2424 that do not have the effect of prohibiting the growing of the fruits
2525 or vegetables in the front, side, or rear yard of a residence,
2626 including:
2727 (1) a requirement that the growing area be maintained
2828 in good condition if visible from the street faced by the lot or
2929 from an adjoining lot; and
3030 (2) a requirement for the trimming or removal of a tree
3131 as necessary for the maintenance of a utility easement.
3232 (c) A municipality may impose reasonable regulations on the
3333 raising or keeping of fowl or rabbits on a single-family
3434 residential lot to control odor, noise, safety, or sanitary
3535 conditions that do not have the effect of prohibiting the raising or
3636 keeping of the fowl or rabbits, including:
3737 (1) a limit on the number of fowl or rabbits that is
3838 more than:
3939 (A) the minimum number allowed by Subsection
4040 (a)(2); or
4141 (B) a total combined number of eight fowl and
4242 rabbits, subject to the limits of Subsection (a)(2);
4343 (2) a prohibition on raising or keeping a rooster;
4444 (3) the minimum distance between an animal shelter and
4545 a residential structure other than the animal owner's own
4646 residence;
4747 (4) a requirement for fencing or shelter sufficient to
4848 contain the fowl or rabbits on the owner's property;
4949 (5) minimum requirements for combined housing and
5050 outdoor space of at least:
5151 (A) 20 square feet per fowl; and
5252 (B) nine square feet per rabbit;
5353 (6) a requirement to address sanitary conditions in a
5454 manner that prevents accumulation of animal waste in a quantity
5555 sufficient to create an offensive odor or attract pests; or
5656 (7) a requirement that the fowl or rabbits may only be
5757 kept in the side or rear yard of a residence.
5858 (d) This section does not apply to a condominium unit.
5959 (e) An ordinance adopted by a municipality that violates
6060 this section is void.
6161 SECTION 2. Chapter 202, Property Code, is amended by adding
6262 Section 202.024 to read as follows:
6363 Sec. 202.024. FOOD PRODUCTION ALLOWED ON SINGLE-FAMILY
6464 RESIDENTIAL LOT. (a) Notwithstanding any other law and except as
6565 provided by this section, a property owners' association may not
6666 adopt or enforce a restrictive covenant that prohibits any of the
6767 following activities on a single-family residential lot:
6868 (1) growing fruits and vegetables;
6969 (2) raising or keeping:
7070 (A) six or fewer domestic fowl; or
7171 (B) six or fewer adult rabbits; or
7272 (3) producing food at a cottage food production
7373 operation, as defined by Section 437.001(2-b), Health and Safety
7474 Code.
7575 (b) A property owners' association may adopt and enforce a
7676 restrictive covenant imposing reasonable requirements on the
7777 growing of fruits and vegetables on a single-family residential lot
7878 that do not have the effect of prohibiting the growing of the fruits
7979 or vegetables in the front, side, or rear yard of a residence,
8080 including:
8181 (1) a requirement that the growing area be maintained
8282 in good condition if visible from the street faced by the lot or
8383 from an adjoining lot; and
8484 (2) a requirement for the trimming or removal of a tree
8585 as necessary for the maintenance of a utility easement.
8686 (c) A property owners' association may adopt and enforce a
8787 restrictive covenant imposing reasonable requirements on the
8888 raising or keeping of fowl or rabbits on a single-family
8989 residential lot to control odor, noise, safety, or sanitary
9090 conditions that do not have the effect of prohibiting the raising or
9191 keeping of the fowl or rabbits, including:
9292 (1) a limit on the number of fowl or rabbits that is
9393 more than:
9494 (A) the minimum number allowed by Subsection
9595 (a)(2); or
9696 (B) a total combined number of eight fowl and
9797 rabbits, subject to the limits of Subsection (a)(2);
9898 (2) a prohibition on raising or keeping a rooster;
9999 (3) the minimum distance between an animal shelter and
100100 a residential structure other than the animal owner's own
101101 residence;
102102 (4) a requirement for fencing or shelter sufficient to
103103 contain the fowl or rabbits on the owner's property;
104104 (5) minimum requirements for combined housing and
105105 outdoor space of at least:
106106 (A) 20 square feet per fowl; and
107107 (B) nine square feet per rabbit;
108108 (6) a requirement to address sanitary conditions in a
109109 manner that prevents accumulation of animal waste in a quantity
110110 sufficient to create an offensive odor or attract pests; or
111111 (7) a requirement that the fowl or rabbits may only be
112112 kept in the side or rear yard of a residence.
113113 (d) This section does not:
114114 (1) restrict a property owners' association from:
115115 (A) regulating the size and shielding of, or the
116116 materials used in the construction of, an animal shelter that is
117117 visible from a street, another lot, or a common area if the
118118 restriction does not prohibit the economic installation of the
119119 animal shelter on the property owner's property;
120120 (B) regulating or prohibiting the installation
121121 of signage by a cottage food operation; or
122122 (C) regulating parking or vehicular or
123123 pedestrian traffic associated with a cottage food operation; or
124124 (2) require a property owners' association to permit
125125 the growing of fruits or vegetables or the raising or keeping of
126126 fowl or rabbits on property:
127127 (A) owned by the property owners' association; or
128128 (B) owned in common by the members of the
129129 property owners' association.
130130 (e) This section does not apply to a condominium council of
131131 owners governed by Chapter 81 or unit owners' association governed
132132 by Chapter 82.
133133 (f) A provision that violates this section is void.
134134 SECTION 3. This Act takes effect September 1, 2023.
