| 7 | 7 | | relating to the age limit for a beginning position in a fire |

| 8 | 8 | | department under municipal civil service. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 143.023(a) and (c), Local Government |
|---|
| 11 | 11 | | Code, are amended to read as follows: |
|---|
| 12 | 12 | | (a) A person may not take an entrance examination for a |
|---|
| 13 | 13 | | beginning position in a [the] police or fire department unless the |
|---|
| 14 | 14 | | person is at least 18 years of age. [A person may not take an |
|---|
| 15 | 15 | | entrance examination for a beginning position in the fire |
|---|
| 16 | 16 | | department unless the person is at least 18 years of age but not 36 |
|---|
| 17 | 17 | | years of age or older.] |
|---|
| 18 | 18 | | (c) A person who is 45 years of age or older may not be |
|---|
| 19 | 19 | | certified for a beginning position in a police or fire department. |
|---|
| 20 | 20 | | SECTION 2. Section 143.083(a), Local Government Code, is |
|---|
| 21 | 21 | | amended to read as follows: |
|---|
| 22 | 22 | | (a) If a municipality is unable to recruit qualified fire |
|---|
| 23 | 23 | | fighters or police officers because of the maximum age limit |
|---|
| 24 | 24 | | prescribed by Section 143.023 and the municipality's governing body |
|---|
| 25 | 25 | | finds that this inability creates an emergency, the commission |
|---|
| 26 | 26 | | shall recommend to the governing body additional rules governing |
|---|
| 27 | 27 | | the temporary employment of persons who are 45 [36] years of age or |
|---|
| 28 | 28 | | older. |
|---|
| 29 | 29 | | SECTION 3. Section 143.023(b), Local Government Code, is |
|---|
| 30 | 30 | | repealed. |
|---|
| 31 | 31 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2023. |
