55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the age limit for a beginning position in a fire
88 department under municipal civil service.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 143.023(a) and (c), Local Government
1111 Code, are amended to read as follows:
1212 (a) A person may not take an entrance examination for a
1313 beginning position in a [the] police or fire department unless the
1414 person is at least 18 years of age. [A person may not take an
1515 entrance examination for a beginning position in the fire
1616 department unless the person is at least 18 years of age but not 36
1717 years of age or older.]
1818 (c) A person who is 45 years of age or older may not be
1919 certified for a beginning position in a police or fire department.
2020 SECTION 2. Section 143.083(a), Local Government Code, is
2121 amended to read as follows:
2222 (a) If a municipality is unable to recruit qualified fire
2323 fighters or police officers because of the maximum age limit
2424 prescribed by Section 143.023 and the municipality's governing body
2525 finds that this inability creates an emergency, the commission
2626 shall recommend to the governing body additional rules governing
2727 the temporary employment of persons who are 45 [36] years of age or
2828 older.
2929 SECTION 3. Section 143.023(b), Local Government Code, is
3030 repealed.
3131 SECTION 4. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2023.
