| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 232, Local Government |
|---|
| 11 | 11 | | Code, is amended by adding Section 232.0035 to read as follows: |

| 12 | 12 | | Sec. 232.0035. ADDITIONAL REQUIREMENTS: FIRE PROTECTION |
|---|
| 13 | 13 | | FOR CERTAIN SUBDIVISIONS. (a) This section applies only to a |
|---|
| 14 | 14 | | residential subdivision that has a lot density that is at least one |
|---|
| 15 | 15 | | lot per five acres. |
|---|
| 16 | 16 | | (b) As part of the required documentation for a plat |
|---|
| 17 | 17 | | application under Section 232.0025(a), the commissioners court of a |
|---|
| 18 | 18 | | county may require the applicant to submit a copy of an agreement |
|---|
| 19 | 19 | | with a political subdivision, volunteer fire department, or similar |
|---|
| 20 | 20 | | organization to provide fire protection services for the |
|---|
| 21 | 21 | | subdivision. |

| 22 | 22 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 23 | 23 | | a plat application filed on or after the effective date of this Act. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect September 1, 2023. |
