55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to access to social media and social networking websites
88 on public school campuses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1111 amended by adding Section 38.0232 to read as follows:
1212 Sec. 38.0232. ACCESS TO SOCIAL MEDIA AND NETWORKING
1313 WEBSITES PROHIBITED; EXCEPTION. (a) A school district or
1414 open-enrollment charter school shall deploy technology to disable
1515 access to social media and social networking Internet websites on a
1616 digital device connected to an Internet service provided at a
1717 district or school campus, including on a digital device owned by
1818 an employee of the district or school while the device is connected
1919 to a campus Internet service.
2020 (b) The technology deployed by a school district or
2121 open-enrollment charter school under Subsection (a) must provide
2222 for a method by which an employee of the school district or
2323 open-enrollment charter school may access an otherwise restricted
2424 social media or social networking Internet website for an
2525 appropriate administrative or educational purpose.
2626 SECTION 2. This Act applies beginning with the 2023-2024
2727 school year.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2023.
