55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the amendment of an existing comprehensive development
88 agreement for a portion of State Highway 130.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 223.208, Transportation Code, is amended
1111 by adding Subsections (i) and (j) to read as follows:
1212 (i) Not later than September 1, 2024, and notwithstanding
1313 Subsection (h), the department shall amend a comprehensive
1414 development agreement entered into on or before March 22, 2007, for
1515 State Highway 130 from U.S. Highway 183 to Interstate Highway 10
1616 (Segments 5 and 6) to extend the term of the agreement for up to 20
1717 additional years if the amendment:
1818 (1) outlines the benefit the state will derive from
1919 extending the term; and
2020 (2) requires the private participant to provide funds
2121 to the department not later than December 31, 2024, in an amount
2222 agreed to by the department and the private participant in
2323 accordance with the requirements of the amendment.
2424 (j) The funds received under Subsection (i)(2) must be used
2525 by the department, or on behalf of the department using the
2626 department's procurement process, for the design, financing, and
2727 construction of a nontolled connector between Interstate Highway 35
2828 and State Highway 130 to be located wholly or partly in a county in
2929 which the project that is the subject of the comprehensive
3030 development agreement described by Subsection (i) is located. The
3131 connector shall be owned by the department.
3232 SECTION 2. This Act takes effect September 1, 2023.
