| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle E, Title 8, Insurance Code, is amended |
|---|
| 11 | 11 | | by adding Chapter 1372 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 1372. COVERAGE FOR LAPAROSCOPIC REMOVAL OF UTERINE FIBROIDS |
|---|
| 13 | 13 | | Sec. 1372.001. APPLICABILITY OF CHAPTER. (a) This chapter |
|---|
| 14 | 14 | | applies only to a health benefit plan that provides benefits for |
|---|
| 15 | 15 | | medical or surgical expenses incurred as a result of a health |
|---|
| 16 | 16 | | condition, accident, or sickness, including an individual, group, |
|---|
| 17 | 17 | | blanket, or franchise insurance policy or insurance agreement, a |
|---|
| 18 | 18 | | group hospital service contract, or an individual or group evidence |
|---|
| 19 | 19 | | of coverage or similar coverage document that is issued by: |
|---|
| 20 | 20 | | (1) an insurance company; |
|---|
| 21 | 21 | | (2) a group hospital service corporation operating |
|---|
| 22 | 22 | | under Chapter 842; |
|---|
| 23 | 23 | | (3) a health maintenance organization operating under |
|---|
| 24 | 24 | | Chapter 843; |
|---|
| 25 | 25 | | (4) an approved nonprofit health corporation that |
|---|
| 26 | 26 | | holds a certificate of authority under Chapter 844; |
|---|
| 27 | 27 | | (5) a multiple employer welfare arrangement that holds |
|---|
| 28 | 28 | | a certificate of authority under Chapter 846; |
|---|
| 29 | 29 | | (6) a stipulated premium company operating under |
|---|
| 30 | 30 | | Chapter 884; |
|---|
| 31 | 31 | | (7) a fraternal benefit society operating under |
|---|
| 32 | 32 | | Chapter 885; |
|---|
| 33 | 33 | | (8) a Lloyd's plan operating under Chapter 941; or |
|---|
| 34 | 34 | | (9) an exchange operating under Chapter 942. |
|---|
| 35 | 35 | | (b) Notwithstanding any other law, this chapter applies to: |
|---|
| 36 | 36 | | (1) a small employer health benefit plan subject to |
|---|
| 37 | 37 | | Chapter 1501, including coverage provided through a health group |
|---|
| 38 | 38 | | cooperative under Subchapter B of that chapter; |
|---|
| 39 | 39 | | (2) a standard health benefit plan issued under |
|---|
| 40 | 40 | | Chapter 1507; |
|---|
| 41 | 41 | | (3) a basic coverage plan under Chapter 1551; |
|---|
| 42 | 42 | | (4) a basic plan under Chapter 1575; |
|---|
| 43 | 43 | | (5) a primary care coverage plan under Chapter 1579; |
|---|
| 44 | 44 | | (6) a plan providing basic coverage under Chapter |
|---|
| 45 | 45 | | 1601; |
|---|
| 46 | 46 | | (7) nonprofit agricultural organization health |
|---|
| 47 | 47 | | benefits offered by a nonprofit agricultural organization under |
|---|
| 48 | 48 | | Chapter 1682; |

| 59 | 59 | | Health and Safety Code; |

| 60 | 60 | | (12) a regional or local health care program operated |
|---|
| 61 | 61 | | under Section 75.104, Health and Safety Code; and |

| 62 | 62 | | (13) a self-funded health benefit plan sponsored by a |
|---|
| 63 | 63 | | professional employer organization under Chapter 91, Labor Code. |
|---|
| 64 | 64 | | Sec. 1372.002. COVERAGE REQUIRED. A health benefit plan |
|---|
| 65 | 65 | | that provides coverage for hysterectomy or myomectomy must provide |
|---|
| 66 | 66 | | coverage for laparoscopic removal of uterine fibroids, including |
|---|
| 67 | 67 | | intraoperative ultrasound guidance and monitoring and |
|---|
| 68 | 68 | | radiofrequency ablation. |
|---|
| 69 | 69 | | SECTION 2. Chapter 1372, Insurance Code, as added by this |
|---|
| 70 | 70 | | Act, applies only to a health benefit plan that is delivered, issued |
|---|
| 71 | 71 | | for delivery, or renewed on or after January 1, 2024. A health |
|---|
| 72 | 72 | | benefit plan delivered, issued for delivery, or renewed before |
|---|
| 73 | 73 | | January 1, 2024, is governed by the law as it existed immediately |
|---|
| 74 | 74 | | before the effective date of this Act, and that law is continued in |
|---|
| 75 | 75 | | effect for that purpose. |
|---|
| 76 | 76 | | SECTION 3. This Act takes effect September 1, 2023. |
