55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the Department of State Health Services' purchase of
88 health benefit plans for certain individuals infected with HIV.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 85, Health and Safety
1111 Code, is amended by adding Section 85.066 to read as follows.
1212 Sec. 85.066. HEALTH BENEFIT PLANS FOR ELIGIBLE INDIVIDUALS.
1313 (a) The department may purchase for individuals infected with HIV
1414 who are enrolled in the HIV medication program established under
1515 this subchapter health benefit plans that:
1616 (1) provide the minimum essential coverage required
1717 under the Patient Protection and Affordable Care Act (Pub. L.
1818 111-148); and
1919 (2) cover the costs of HIV medications and of testing
2020 and treatment for HIV.
2121 (b) The executive commissioner by rule shall institute a
2222 sliding fee scale to assist an eligible individual infected with
2323 HIV with the cost of a premium, deductible, coinsurance, or other
2424 cost-sharing payment related to a health benefit plan purchased
2525 under this section.
2626 SECTION 2. As soon as practicable after the effective date
2727 of this Act, the executive commissioner of the Health and Human
2828 Services Commission shall adopt rules necessary to implement
2929 Section 85.066, Health and Safety Code, as added by this Act.
3030 SECTION 3. This Act takes effect September 1, 2023.
