| 7 | 7 | | relating to the Department of State Health Services' purchase of |

| 8 | 8 | | health benefit plans for certain individuals infected with HIV. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 85, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 85.066 to read as follows. |
|---|
| 12 | 12 | | Sec. 85.066. HEALTH BENEFIT PLANS FOR ELIGIBLE INDIVIDUALS. |
|---|
| 13 | 13 | | (a) The department may purchase for individuals infected with HIV |
|---|
| 14 | 14 | | who are enrolled in the HIV medication program established under |
|---|
| 15 | 15 | | this subchapter health benefit plans that: |
|---|
| 16 | 16 | | (1) provide the minimum essential coverage required |
|---|
| 17 | 17 | | under the Patient Protection and Affordable Care Act (Pub. L. |
|---|
| 18 | 18 | | 111-148); and |
|---|
| 19 | 19 | | (2) cover the costs of HIV medications and of testing |
|---|
| 20 | 20 | | and treatment for HIV. |
|---|
| 21 | 21 | | (b) The executive commissioner by rule shall institute a |
|---|
| 22 | 22 | | sliding fee scale to assist an eligible individual infected with |
|---|
| 23 | 23 | | HIV with the cost of a premium, deductible, coinsurance, or other |
|---|
| 24 | 24 | | cost-sharing payment related to a health benefit plan purchased |
|---|
| 25 | 25 | | under this section. |
|---|
| 26 | 26 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 27 | 27 | | of this Act, the executive commissioner of the Health and Human |
|---|
| 28 | 28 | | Services Commission shall adopt rules necessary to implement |
|---|
| 29 | 29 | | Section 85.066, Health and Safety Code, as added by this Act. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2023. |
