77 relating to the finality of public school accountability

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Subchapter F, Chapter 39,
1111 Education Code, is amended to read as follows:
1212 SUBCHAPTER F. PROCEDURES FOR CHALLENGE OF ACCOUNTABILITY
1313 DETERMINATION; FINALITY OF ACCOUNTABILITY DETERMINATION
1414 SECTION 2. Section 39.151(e), Education Code, is amended to
1515 read as follows:
1616 (e) A school district or open-enrollment charter school may
1717 not challenge an agency decision relating to an academic or
1818 financial accountability rating under this chapter, including a
1919 decision relating to a determination of consecutive school years of
2020 unacceptable performance ratings:
2121 (1) after the agency has released the district's or
2222 school's final academic or financial accountability rating, as
2323 applicable, under this chapter for the school year; or
2424 (2) [,] in another proceeding if the district or
2525 school has had an opportunity to challenge the decision under this
2626 section.
2727 SECTION 3. Subchapter F, Chapter 39, Education Code, is
2828 amended by adding Section 39.152 to read as follows:
2929 Sec. 39.152. FINALITY OF RATINGS. The agency may not audit,
3030 investigate, or otherwise modify the academic or financial
3131 accountability rating assigned to a school district or
3232 open-enrollment charter school under this chapter for a school year
3333 after the agency has released the district's or school's final
3434 academic or financial accountability rating, as applicable, under
3535 this chapter for that school year.
3636 SECTION 4. The changes in law made by this Act apply only to
3737 an academic or financial accountability rating assigned for the
3838 2023-2024 school year or a later school year.
3939 SECTION 5. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2023.
