| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Subchapter F, Chapter 39, |
|---|
| 11 | 11 | | Education Code, is amended to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER F. PROCEDURES FOR CHALLENGE OF ACCOUNTABILITY |
|---|
| 13 | 13 | | DETERMINATION; FINALITY OF ACCOUNTABILITY DETERMINATION |
|---|
| 14 | 14 | | SECTION 2. Section 39.151(e), Education Code, is amended to |
|---|
| 15 | 15 | | read as follows: |
|---|
| 16 | 16 | | (e) A school district or open-enrollment charter school may |
|---|
| 17 | 17 | | not challenge an agency decision relating to an academic or |
|---|
| 18 | 18 | | financial accountability rating under this chapter, including a |
|---|
| 19 | 19 | | decision relating to a determination of consecutive school years of |
|---|
| 20 | 20 | | unacceptable performance ratings: |
|---|
| 21 | 21 | | (1) after the agency has released the district's or |
|---|
| 22 | 22 | | school's final academic or financial accountability rating, as |
|---|
| 23 | 23 | | applicable, under this chapter for the school year; or |
|---|
| 24 | 24 | | (2) [,] in another proceeding if the district or |
|---|
| 25 | 25 | | school has had an opportunity to challenge the decision under this |
|---|
| 26 | 26 | | section. |

| 27 | 27 | | SECTION 3. Subchapter F, Chapter 39, Education Code, is |
|---|
| 28 | 28 | | amended by adding Section 39.152 to read as follows: |
|---|
| 29 | 29 | | Sec. 39.152. FINALITY OF RATINGS. The agency may not audit, |
|---|
| 30 | 30 | | investigate, or otherwise modify the academic or financial |
|---|
| 31 | 31 | | accountability rating assigned to a school district or |
|---|
| 32 | 32 | | open-enrollment charter school under this chapter for a school year |
|---|
| 33 | 33 | | after the agency has released the district's or school's final |
|---|
| 34 | 34 | | academic or financial accountability rating, as applicable, under |
|---|
| 35 | 35 | | this chapter for that school year. |
|---|
| 36 | 36 | | SECTION 4. The changes in law made by this Act apply only to |
|---|
| 37 | 37 | | an academic or financial accountability rating assigned for the |
|---|
| 38 | 38 | | 2023-2024 school year or a later school year. |
|---|
| 39 | 39 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2023. |
