66 AN ACT
77 relating to the use of a volunteer school protection force
88 established by a county sheriff for purposes of school district
99 safety.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 37, Education Code, is
1212 amended by adding Section 37.0816 to read as follows:
1313 Sec. 37.0816. VOLUNTEER SCHOOL PROTECTION FORCE. (a) The
1414 board of trustees of a school district may enter into a memorandum
1515 of understanding with the sheriff of a county in which the school
1616 district is located to provide security services and school safety
1717 at district campuses with a volunteer school protection force
1818 established by the sheriff under Section 85.024, Local Government
1919 Code.
2020 (b) A memorandum of understanding entered into under
2121 Subsection (a):
2222 (1) must require:
2323 (A) the district to provide written regulations
2424 or written authorization in accordance with Section 46.03(a)(1),
2525 Penal Code, for each member of the volunteer school protection
2626 force to carry or possess a firearm at district campuses for the
2727 purpose of providing security services and school safety; and
2828 (B) members of the volunteer school protection
2929 force to only act to prevent injury to students, school staff, or
3030 other members of the community without undertaking any other duties
3131 of a peace officer, a school resource officer, security personnel,
3232 or an educator; and
3333 (2) may grant the sheriff decision-making authority
3434 over decisions affecting school safety.
3535 SECTION 2. Subchapter B, Chapter 85, Local Government Code,
3636 is amended by adding Section 85.024 to read as follows:
3737 Sec. 85.024. VOLUNTEER SCHOOL PROTECTION FORCE. (a) In
3838 this section, "school protection force" means a volunteer school
3939 protection force established under this section.
4040 (b) A sheriff who enters into a memorandum of understanding
4141 with a school district under Section 37.0816, Education Code,
4242 authorizing the sheriff to engage a school protection force may
4343 recruit members of the force to provide security services and
4444 school safety at school district campuses, in the manner provided
4545 under the memorandum.
4646 (c) Members recruited under Subsection (b) may include
4747 volunteers who:
4848 (1) are either:
4949 (A) a former law enforcement officer;
5050 (B) a military veteran; or
5151 (C) another competent individual, as determined
5252 in the sheriff's sole discretion; and
5353 (2) meet the minimum standards for licensure
5454 established by the Texas Commission on Law Enforcement under
5555 Section 1701.151, Occupations Code, and other applicable
5656 requirements for licensure as a peace officer as provided by
5757 commission rule.
5858 (d) The sheriff's department:
5959 (1) must provide members of a school protection force
6060 with:
6161 (A) any necessary training for service on a
6262 school protection force, as determined by the sheriff; and
6363 (B) radio communication equipment or a crisis
6464 alert badge that allows for immediate communication in an
6565 emergency; and
6666 (2) may provide a member of a school protection force
6767 appropriate ammunition for a firearm authorized under the
6868 memorandum of understanding under Section 37.0816(b), Education
6969 Code, and legally possessed by the member for the purpose of
7070 providing security services and school safety as a member of a
7171 school protection force.
7272 (e) A member of a school protection force:
7373 (1) may only act to prevent injury to students, school
7474 staff, and other members of the community;
7575 (2) must complete any training required by the sheriff
7676 under Subsection (d)(1); and
7777 (3) must provide any necessary equipment not provided
7878 by the sheriff's department.
7979 (f) A sheriff's department may accept donations or
8080 assistance, including assistance from a council of government
8181 created under Chapter 391, for purposes of providing training or
8282 equipment to members of a school protection force under this
8383 section.
8484 SECTION 3. This Act applies beginning with the 2023-2024
8585 school year.
8686 SECTION 4. This Act takes effect immediately if it receives
8787 a vote of two-thirds of all the members elected to each house, as
8888 provided by Section 39, Article III, Texas Constitution. If this
8989 Act does not receive the vote necessary for immediate effect, this
9090 Act takes effect September 1, 2023.
