6 | 6 | | relating to the ownership and operation of columbariums by funeral |

7 | 7 | | establishment license holders. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 651.351, Occupations Code, is amended by |
---|
10 | 10 | | adding Subsection (j) to read as follows: |
---|
11 | 11 | | (j) A funeral establishment may own and operate a |
---|
12 | 12 | | columbarium, as defined by Section 711.001, Health and Safety Code, |
---|
13 | 13 | | for the purpose of storing cremated remains. A funeral |
---|
14 | 14 | | establishment that owns or operates a columbarium must: |
---|
15 | 15 | | (1) establish a perpetual care and maintenance fund to |
---|
16 | 16 | | support the continued care, maintenance, and transition of stored |
---|
17 | 17 | | remains of the columbarium; and |
---|
18 | 18 | | (2) own the property where the funeral establishment |
---|
19 | 19 | | and columbarium are located. |
---|
20 | 20 | | SECTION 2. This Act takes effect immediately if it receives |
---|
21 | 21 | | a vote of two-thirds of all the members elected to each house, as |
---|
22 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
23 | 23 | | Act does not receive the vote necessary for immediate effect, this |
---|
24 | 24 | | Act takes effect September 1, 2023. |
