| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 2, Election Code, is amended by adding |
|---|
| 10 | 10 | | Subchapter E to read as follows: |
|---|
| 11 | 11 | | SUBCHAPTER E. PREFERENTIAL VOTING |
|---|
| 12 | 12 | | Sec. 2.101. PREFERENTIAL VOTING IN MUNICIPALITY ELECTIONS. |
|---|
| 13 | 13 | | (a) This section applies only to a municipality that has authorized |
|---|
| 14 | 14 | | the use of preferential voting in its city charter. |
|---|
| 15 | 15 | | (b) An election of an officer of a municipality may use a |
|---|
| 16 | 16 | | preferential voting system. |
|---|
| 17 | 17 | | (c) The secretary of state shall prescribe procedures to |
|---|
| 18 | 18 | | provide for an election of an officer of a municipality to use a |
|---|
| 19 | 19 | | preferential voting system. The system must allow a voter to rank |
|---|
| 20 | 20 | | each candidate through a numerical designation from the candidate |
|---|
| 21 | 21 | | the voter favors most to the candidate the voter favors least. |
|---|
| 22 | 22 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 23 | 23 | | to an election ordered on or after the effective date of this Act. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect September 1, 2023. |
