55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of a living organ donor education
88 program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
1111 amended by adding Chapter 54 to read as follows:
1212 CHAPTER 54. LIVING ORGAN DONOR EDUCATION PROGRAM
1313 Sec. 54.001. ESTABLISHMENT OF PROGRAM. (a) The department
1414 shall establish a living organ donor education program to educate
1515 residents of this state about:
1616 (1) the need for living organ donors, including the
1717 particular need for donors from minority populations;
1818 (2) the requirements for registering with the National
1919 Donate Life Living Donor Registry through Donate Life America as a
2020 potential living organ donor;
2121 (3) the medical screening and procedures necessary for
2222 an individual to be a living organ donor; and
2323 (4) the availability of information about living organ
2424 donation in health care facilities, transplant centers, organ
2525 procurement organizations, tissue banks, eye banks, and driver's
2626 license offices.
2727 (b) The department, in consultation with Donate Life
2828 America, shall develop written and electronic informational
2929 materials, including links to Internet websites and
3030 machine-readable codes, regarding:
3131 (1) living organ donation; and
3232 (2) the process of registering with the National
3333 Donate Life Living Donor Registry.
3434 (c) Donate Life America may develop and provide the
3535 informational materials described by Subsection (b) to the
3636 department.
3737 (d) The department and the Department of Public Safety shall
3838 post the information described by Subsection (b) on each of the
3939 agency's Internet websites.
4040 (e) Appropriate health care facilities, transplant centers,
4141 organ procurement organizations, tissue banks, eye banks, and
4242 driver's license offices may access the informational materials
4343 described by Subsection (b) on the Internet websites of the
4444 department and the Department of Public Safety and print the
4545 materials to place in their facilities or offices to provide to
4646 residents of this state.
4747 SECTION 2. As soon as practicable after the effective date
4848 of this Act, the Department of State Health Services shall
4949 establish the program and obtain the informational materials as
5050 required by Section 54.001, Health and Safety Code, as added by this
5151 Act.
5252 SECTION 3. This Act takes effect September 1, 2023.
