| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle B, Title 2, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by adding Chapter 54 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 54. LIVING ORGAN DONOR EDUCATION PROGRAM |
|---|
| 13 | 13 | | Sec. 54.001. ESTABLISHMENT OF PROGRAM. (a) The department |
|---|
| 14 | 14 | | shall establish a living organ donor education program to educate |
|---|
| 15 | 15 | | residents of this state about: |
|---|
| 16 | 16 | | (1) the need for living organ donors, including the |
|---|
| 17 | 17 | | particular need for donors from minority populations; |
|---|
| 18 | 18 | | (2) the requirements for registering with the National |
|---|
| 19 | 19 | | Donate Life Living Donor Registry through Donate Life America as a |
|---|
| 20 | 20 | | potential living organ donor; |
|---|
| 21 | 21 | | (3) the medical screening and procedures necessary for |
|---|
| 22 | 22 | | an individual to be a living organ donor; and |
|---|
| 23 | 23 | | (4) the availability of information about living organ |
|---|
| 24 | 24 | | donation in health care facilities, transplant centers, organ |
|---|
| 25 | 25 | | procurement organizations, tissue banks, eye banks, and driver's |
|---|
| 26 | 26 | | license offices. |
|---|
| 27 | 27 | | (b) The department, in consultation with Donate Life |
|---|
| 28 | 28 | | America, shall develop written and electronic informational |
|---|
| 29 | 29 | | materials, including links to Internet websites and |
|---|
| 30 | 30 | | machine-readable codes, regarding: |
|---|
| 31 | 31 | | (1) living organ donation; and |
|---|
| 32 | 32 | | (2) the process of registering with the National |
|---|
| 33 | 33 | | Donate Life Living Donor Registry. |
|---|
| 34 | 34 | | (c) Donate Life America may develop and provide the |
|---|
| 35 | 35 | | informational materials described by Subsection (b) to the |
|---|
| 36 | 36 | | department. |
|---|
| 37 | 37 | | (d) The department and the Department of Public Safety shall |
|---|
| 38 | 38 | | post the information described by Subsection (b) on each of the |
|---|
| 39 | 39 | | agency's Internet websites. |
|---|
| 40 | 40 | | (e) Appropriate health care facilities, transplant centers, |
|---|
| 41 | 41 | | organ procurement organizations, tissue banks, eye banks, and |
|---|
| 42 | 42 | | driver's license offices may access the informational materials |
|---|
| 43 | 43 | | described by Subsection (b) on the Internet websites of the |
|---|
| 44 | 44 | | department and the Department of Public Safety and print the |
|---|
| 45 | 45 | | materials to place in their facilities or offices to provide to |
|---|
| 46 | 46 | | residents of this state. |
|---|
| 47 | 47 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 48 | 48 | | of this Act, the Department of State Health Services shall |
|---|
| 49 | 49 | | establish the program and obtain the informational materials as |
|---|
| 50 | 50 | | required by Section 54.001, Health and Safety Code, as added by this |
|---|
| 51 | 51 | | Act. |
|---|
| 52 | 52 | | SECTION 3. This Act takes effect September 1, 2023. |
