55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the permitting of and performance of annual soil tests
88 for certain concentrated animal feeding operations by the Texas
99 Commission on Environmental Quality.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 26.503, Water Code, is amended by
1212 amending Subsections (a), (b), and (f) and adding Subsection (g) to
1313 read as follows:
1414 (a) The commission may authorize the construction or
1515 operation of a new concentrated animal feeding operation, or an
1616 increase in the animals confined under an existing operation, only
1717 by a new or amended general [individual] permit.
1818 (b) The general [individual] permit issued or amended under
1919 Subsection (a) must:
2020 (1) provide for management and disposal of waste in
2121 accordance with Subchapter B, Chapter 321, Title 30, Texas
2222 Administrative Code;
2323 (2) require that 100 percent of the collectible manure
2424 produced by the additional animals in confinement at an expanded
2525 operation or all of the animals in confinement at a new operation
2626 must be:
2727 (A) disposed of or used outside of the watershed;
2828 (B) delivered to a composting facility approved
2929 by the executive director;
3030 (C) applied as directed by the commission to a
3131 waste application field owned or controlled by the owner of the
3232 concentrated animal feeding operation, if the field is not a
3333 historical waste application field;
3434 (D) put to another beneficial use approved by the
3535 executive director; or
3636 (E) applied to a historical waste application
3737 field that is owned or operated by the owner or operator of the
3838 concentrated animal feeding operation only if:
3939 (i) results of representative composite
4040 soil sampling conducted at the waste application field and filed
4141 with the commission show that the waste application field contains
4242 200 or fewer parts per million of extractable phosphorus (reported
4343 as P); or
4444 (ii) the manure is applied, with commission
4545 approval, in accordance with a detailed nutrient utilization plan
4646 approved by the commission that is developed by:
4747 (a) an employee of the United States
4848 Department of Agriculture's Natural Resources Conservation
4949 Service;
5050 (b) a nutrient management specialist
5151 certified by the United States Department of Agriculture's Natural
5252 Resources Conservation Service;
5353 (c) the State Soil and Water
5454 Conservation Board;
5555 (d) the Texas A&M AgriLife
5656 [Agricultural] Extension Service;
5757 (e) an agronomist or soil scientist on
5858 the full-time staff of an accredited university located in this
5959 state; or
6060 (f) a professional agronomist or soil
6161 scientist certified by the American Society of Agronomy.
6262 (f) This section does not limit the commission's authority
6363 to include in a [an individual or] general permit under this chapter
6464 provisions necessary to protect a water resource in this state.
6565 (g) This subsection applies only to an operator of a
6666 concentrated animal feeding operation. The commission by rule or
6767 as a condition of a general permit issued under this section:
6868 (1) may not require an operator to receive training on
6969 animal waste management; and
7070 (2) shall require an operator to retain and submit to
7171 the commission on request a record of:
7272 (A) the amount of manure, litter, or wastewater
7373 from the operation applied to a third-party waste application
7474 field, including the location of the application and the name of the
7575 third party; and
7676 (B) the results of a testing analysis of a soil
7777 sample performed on behalf of the operator.
7878 SECTION 2. Section 26.504, Water Code, is amended by
7979 amending Subsection (a) and adding Subsection (f) to read as
8080 follows:
8181 (a) The commission shall collect one or more representative
8282 composite soil samples from each permitted waste application field
8383 associated with a concentrated animal feeding operation. The
8484 commission shall perform the sampling under this subsection not
8585 less often than once every 12 months. Sampling results obtained by
8686 the commission shall be used by the permitted concentrated animal
8787 feeding operator to satisfy any annual sampling of permitted waste
8888 application fields required by commission rule or general
8989 [individual] permit.
9090 (f) A general permit described by Section 26.503(g):
9191 (1) must specify that required soil samples be taken
9292 at depths of zero to six inches;
9393 (2) must require soil sample results to be included in
9494 the annual report provided to the commission; and
9595 (3) may not require soil sampling of a third-party
9696 waste application field.
9797 SECTION 3. The following provisions of the Water Code are
9898 repealed:
9999 (1) Section 26.503(d); and
100100 (2) Section 26.504(c).
101101 SECTION 4. This Act takes effect September 1, 2023.
