| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 46, Penal Code, is amended by adding |

| 11 | 11 | | Section 46.055 to read as follows: |

| 12 | 12 | | Sec. 46.055. UNLAWFUL TRANSFER OF SEMIAUTOMATIC RIFLE. (a) |
|---|
| 13 | 13 | | A person commits an offense if the person knowingly sells, rents, |
|---|
| 14 | 14 | | leases, or otherwise transfers, or offers to sell, rent, lease, or |
|---|
| 15 | 15 | | otherwise transfer a semiautomatic rifle. |
|---|
| 16 | 16 | | (b) An offense under this section is a state jail felony. |
|---|
| 17 | 17 | | (c) If conduct that constitutes an offense under this |
|---|
| 18 | 18 | | section also constitutes an offense under any other law, the actor |
|---|
| 19 | 19 | | may be prosecuted under this section, the other law, or both. |
|---|
| 20 | 20 | | SECTION 2. This Act takes effect September 1, 2023. |
