55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a requirement to report certain multiple semiautomatic
88 rifle sales and other transfers to the county sheriff.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 6, Business & Commerce Code, is amended by
1111 adding Chapter 205 to read as follows:
1212 CHAPTER 205. REPORTS OF CERTAIN MULTIPLE FIREARM TRANSFERS
1313 Sec. 205.001. DEFINITION. In this chapter, "licensed
1414 firearms dealer" means a person who is licensed as a firearms dealer
1515 under 18 U.S.C. Section 923.
1616 Sec. 205.002. APPLICABILITY. This chapter applies only to
1717 a semiautomatic rifle that:
1818 (1) is capable of accepting a detachable magazine; and
1919 (2) has a caliber greater than .22.
2020 Sec. 205.003. REPORT. A licensed firearms dealer who, on a
2121 single occasion or during a period of five consecutive business
2222 days, sells or otherwise transfers two or more semiautomatic rifles
2323 described by Section 205.002 to the same person, other than a
2424 licensed firearms dealer, promptly shall report each of the
2525 transfers made to that person to the sheriff of each county in which
2626 those transfers occurred.
2727 SECTION 2. The change in law made by this Act applies only
2828 to the sale or other transfer of a firearm that occurs on or after
2929 the effective date of this Act. A sale or other transfer of a
3030 firearm that occurs before the effective date of this Act is
3131 governed by the law in effect immediately before the effective date
3232 of this Act, and that law is continued in effect for that purpose.
3333 SECTION 3. This Act takes effect September 1, 2023.
