66 AN ACT
77 relating to requiring the legislature to set the basic allotment
88 and guaranteed yield under the public school finance system at
99 certain amounts in the General Appropriations Act.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter F, Chapter 48, Education Code, is
1212 amended by adding Section 48.2511 to read as follows:
1313 Sec. 48.2511. APPROPRIATION FOR PUBLIC EDUCATION. (a) In
1414 each biennial General Appropriations Act, the legislature shall set
1515 the basic allotment under Section 48.051 and the dollar amount
1616 guaranteed level of state and local funds per weighted student per
1717 cent of tax effort ("GL") under Section 48.202 for each state fiscal
1818 year at:
1919 (1) the amounts necessary for the amount of state
2020 funds to which all school districts are jointly entitled under this
2121 chapter, together with state funds to which all school districts
2222 are jointly entitled for that state fiscal year under any other law
2323 that provides funding for the general maintenance and operation of
2424 the system of public free schools, to constitute, as determined by
2525 the legislature, at least 50 percent of the cost of maintaining and
2626 operating that system; or
2727 (2) amounts greater than the amounts specified by
2828 Subdivision (1).
2929 (b) For purposes of calculating the amount of state funds
3030 required under Subsection (a), the legislature may not consider
3131 money that is attributable to an ad valorem tax imposed by a school
3232 district on property located in the school district, including any
3333 revenue the school district is required to transfer to the state to
3434 reduce the school district's local revenue level in accordance with
3535 Chapter 49.
3636 SECTION 2. This Act takes effect September 1, 2023.
