66 AN ACT
77 relating to voting by a voter unable to enter a polling place.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 64.009(a), Election Code, is amended to
1010 read as follows:
1111 (a) On [If a voter is physically unable to enter the polling
1212 place without personal assistance or likelihood of injuring the
1313 voter's health, on] the voter's request, an election officer shall
1414 deliver a ballot to the voter at the polling place entrance or curb
1515 if the voter:
1616 (1) is physically unable to enter the polling place
1717 without personal assistance or likelihood of injuring the voter's
1818 health;
1919 (2) has legal custody of a child younger than 12 years
2020 of age and entering the polling place would require leaving the
2121 child without adequate supervision; or
2222 (3) is the primary caretaker of a person who is unable
2323 to care for themselves and entering the polling place would require
2424 leaving the person without adequate supervision.
2525 SECTION 2. This Act takes effect September 1, 2023.
