| 7 | 7 | | relating to voting by a voter unable to enter a polling place. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 64.009(a), Election Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (a) On [If a voter is physically unable to enter the polling |
|---|
| 12 | 12 | | place without personal assistance or likelihood of injuring the |
|---|
| 13 | 13 | | voter's health, on] the voter's request, an election officer shall |
|---|
| 14 | 14 | | deliver a ballot to the voter at the polling place entrance or curb |
|---|
| 15 | 15 | | if the voter: |
|---|
| 16 | 16 | | (1) is physically unable to enter the polling place |
|---|
| 17 | 17 | | without personal assistance or likelihood of injuring the voter's |
|---|
| 18 | 18 | | health; |
|---|
| 19 | 19 | | (2) has legal custody of a child younger than 12 years |
|---|
| 20 | 20 | | of age and entering the polling place would require leaving the |
|---|
| 21 | 21 | | child without adequate supervision; or |
|---|
| 22 | 22 | | (3) is the primary caretaker of a person who is unable |
|---|
| 23 | 23 | | to care for themselves and entering the polling place would require |
|---|
| 24 | 24 | | leaving the person without adequate supervision. |

| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2023. |
