8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 64.009(a), Election Code, is amended to |
---|
10 | 10 | | read as follows: |
---|
11 | 11 | | (a) On [If a voter is physically unable to enter the polling |
---|
12 | 12 | | place without personal assistance or likelihood of injuring the |
---|
13 | 13 | | voter's health, on] the voter's request, an election officer shall |
---|
14 | 14 | | deliver a ballot to the voter at the polling place entrance or curb |
---|
15 | 15 | | if the voter: |
---|
16 | 16 | | (1) is physically unable to enter the polling place |
---|
17 | 17 | | without personal assistance or likelihood of injuring the voter's |
---|
18 | 18 | | health; |
---|
19 | 19 | | (2) has legal custody of a child younger than 12 years |
---|
20 | 20 | | of age and entering the polling place would require leaving the |
---|
21 | 21 | | child without adequate supervision; or |
---|
22 | 22 | | (3) is the primary caretaker of a person who is unable |
---|
23 | 23 | | to care for themselves and entering the polling place would require |
---|
24 | 24 | | leaving the person without adequate supervision. |

25 | 25 | | SECTION 2. This Act takes effect September 1, 2023. |
